Yet these achievements have not produced a significant shift in the lived experience of Islam, particularly with respect to equality and justice in Muslim families. A new approach is needed: one that examines the underlying instruments of tradition and explores avenues for effecting change. In Islamic Interpretive Tradition and Gender Justice leading intellectuals and emerging researchers grapple with the problem of entrenched positions within Islam that affect women, investigating the processes by which interpretations become authoritative, the theoretical foundations upon which they stand, and the ways they have been used to inscribe and enforce gender limitations. Together, they argue that the Islamic interpretive tradition displays all the trappings of canonical texts, canonical figures, and canon law – despite the fact that Islam does not ordain religious authorities who could sanction processes of canonization. Through this lens, the essays in this collection offer insights into key issues in Islamic feminist scholarship, ranging from interreligious love, child marriage, polygamy, and divorce to stoning, segregation, seclusion, and gender hierarchies. Based on an examination of several apparently problematic Qurʾānic narrative pericopes and how the exegetes grappled with them, the book demonstrates that the moral world of the Qurʾān is polyvalent and non-linear, owing, above all, to its intrinsic ethical antinomies and textual ambiguities. That is, the book contends that paradox and uncertainty are both constituents of the Qurʾān’s ethical architectonics, and that through these constituents the Qurʾān charts a system of ethics that seeks to tread in the midst of a non-ideal world rife with uncertainty. The book also argues that the tafsīr tradition tends to erode the hermeneutical openness of the Qurʾān and, thereby, limits the Qurʾān’s ethical potential. The book, thus, advances our understanding of Qurʾānic ethics and contributes to the field of tafsīr studies and to the scholarship on Qurʾānic hermeneutics.

Beginning with the case study of a Muslim basketball player who refused to stand up while the American national anthem was playing, the author documents the disintegration of the Islamic juristic tradition, and the prevalence of authoritarianism in contemporary Muslim discourses. The author analyzes the rise of what he describes as puritan and despotic trends in modern Islam, and asserts that such trends nullify the richness and diversity of the Islamic tradition. By declaring themselves the true soldiers of God and the defenders of religion, Muslim puritan movements are able to degrade women, eradicate critical thinking, and empty Islam of its moral content. In effect, the author argues, the self-declared protectors of Islam become its despots and oppressors who suppress the dynamism and vigor of the Islamic message. Anchoring himself in the rich Islamic jurisprudential tradition, the author argues for upholding the authoritativeness of the religious text without succumbing to authoritarian methodologies of interpretation. Ultimately, the author asserts that in order to respect the integrity of the Divine laws it is necessary to adopt rigorous analytical methodologies of interpretation, and to re-investigate the place of morality in modern Islam.
