In what form is equality present in traditional forms of electoral representation? How can it be secured in new forms of representation, such as claims-making, deliberative, klerotarian and epistemic representation? And to what extent are electoral or non-electoral models of representation able to accommodate increasing social inequalities? The articles in this volume discuss these issues from a normative and conceptual point of view, seeking to shed new light on the important but under-explored relationship between equality and representation. The Dissenting community fought for the civil rights of Roman Catholics, non-Christians, and even atheists, on an issue of principle that had its flowering in the enthusiastic and undivided support that Nonconformity gave to the campaign for Jewish emancipation. This study examines the political efforts and ideas of English Nonconformists during the period, covering the whole range of national issues raised, from state education to the Crimean War. It offers a case study of a theologically conservative group defending religious pluralism in the civic sphere, showing the that concept of religious equality was a grand vision at the center of the political philosophy of the Dissenters.

Or can we somehow combine these two ideas, saying that the best person should always get the job, but that everyone should have an equal chance to become the best? These seem to be the standard views, but this book argues that they are all flawed. We need to understand meritocracy for what it is - a technical rather than a moral ideal; and we need to accept that equality just isn't something we should be striving for at all in this area. We also need to rethink our approach to the related issue of discrimination. We tend to assume discrimination is wrong because it violates either meritocracy or equality, when in fact it is wrong for quite different reasons. In all these areas, then, Cavanagh aims to loosen the grip of established ways of thinking, in order that other ideas might find room to breathe. This is particularly important in the case of meritocracy, which after the recent conversion of the centre-left now dominates the debate more than ever. This book will be of interest to students and teachers of political philosophy, but ultimately it is aimed at anyone who cares about the fundamental values that lie behind the way society is organized. Though the argument is rigorous, it does not require a professional philosophical training to follow it.

Given the fact that stabilization clauses freeze the law for as long as the contract subsists there has been debate on the negative impact stabilization clauses have on the progressive development of human rights in the host State. Firstly, the book examines the mechanisms investors utilise in protecting themselves from host State prerogatives. It then explores the theoretical basis on which stabilization clauses are applied and upheld by arbitral tribunals, and assesses how they can be drafted in a way that protects human rights, particularly in relation to gender discrimination, without forcing the resource rich nations to lose momentum in attracting foreign direct investment. Using Zambia and the Gender Equity and Equality Act of 2015 as a case study, the book explores the compatibility of the legislation with the stabilization clauses contained in the country’s Development Agreements. The book will be of interest to practitioners, scholars and students of international investment law, human rights law and contract law.
