Available in PDF, EPUB and Kindle. Book excerpt: One of the academy’s leading legal historians, William E. Nelson is the Edward Weinfeld Professor of Law at New York University School of Law. For more than four decades, Nelson has produced some of the most original and creative work on American constitutional and legal history. His prize-winning books have blazed new trails for historians with their substantive arguments and the scope and depth of Nelson’s exploration of primary sources. Nelson was the first legal scholar to use early American county court records as sources of legal and social history, and his work (on legal history in England, colonial America, and New York) has been a model for generations of legal historians. This book collects ten essays exemplifying and explaining the process of identifying and interpreting archival sources—the foundation of an array of methods of writing American legal history. The essays presented here span the full range of American history from the colonial era to the 1980s.Each historian has either identified a body of sources not previously explored or devised a new method of interrogating sources already known. The result is a kaleidoscopic examination of the historian’s task and of the research methods and interpretative strategies that characterize the rich, complex field of American constitutional and legal history.

Available in PDF, EPUB and Kindle. Book excerpt: This collection of seventeen original essays reshapes the field of early American legal history not by focusing simply on law, or even on the relationship between law and society, but by using the concept of "legality" to explore the myriad ways in which the people of early America ordered their relationships with one another, whether as individuals, groups, classes, communities, or states. Addressing issues of gender, ethnicity, family, patriarchy, culture, and dependence, contributors explore the transatlantic context of early American law, the negotiation between European and indigenous legal cultures, the multiple social contexts of the rule of law, and the transformation of many legalities into an increasingly uniform legal culture. Taken together, these essays reveal the extraordinary diversity and complexity of the roots of early America's legal culture. Contributors are Mary Sarah Bilder, Holly Brewer, James F. Brooks, Richard Lyman Bushman, Christine Daniels, Cornelia Hughes Dayton, David Barry Gaspar, Katherine Hermes, John G. Kolp, David Thomas Konig, James Muldoon, William M. Offutt Jr., Ann Marie Plane, A. G. Roeber, Terri L. Snyder, and Linda L. Sturtz.

Available in PDF, EPUB and Kindle. Book excerpt: What can and can't be copied is a matter of law, but also of aesthetics, culture, and economics. The act of copying, and the creation and transaction of rights relating to it, evokes fundamental notions of communication and censorship, of authorship and ownership - of privilege and property. This volume conceives a new history of copyright law that has its roots in a wide range of norms and practices. The essays reach back to the very material world of craftsmanship and mechanical inventions of Renaissance Italy where, in 1469, the German master printer Johannes of Speyer obtained a five-year exclusive privilege to print in Venice and its dominions. Along the intellectual journey that follows, we encounter John Milton who, in his 1644 Areopagitica speech 'For the Liberty of Unlicensed Printing', accuses the English parliament of having been deceived by the 'fraud of some old patentees and monopolizers in the trade of bookselling' (i.e. the London Stationers' Company). Later revisionary essays investigate the regulation of the printing press in the North American colonies as a provincial and somewhat crude version of European precedents, and how, in the revolutionary France of 1789, the subtle balance that the royal decrees had established between the interests of the author, the bookseller, and the public, was shattered by the abolition of the privilege system. Contributions also address the specific evolution of rights associated with the visual and performing arts. These essays provide essential reading for anybody interested in copyright, intellectual history and current public policy choices in intellectual property. The volume is a companion to the digital archive Primary Sources on Copyright (1450-1900), funded by the UK Arts and Humanities Research Council (AHRC): www.copyrighthistory.org.

They address the main areas of his research, nineteenth century Louisiana and seventeenth century Virginia. From Opechancanough, a seventeenth-century Indian chief to Sir William Berkeley, colonial governor of Virginia, to Edward Livingston, coauthor of Louisiana's first civil code, to the legendary Louisiana Governor and U.S. Senator Huey Long, Billings brings to life the forces behind the legal development of these two historically distinctive states. Many of these are classic essays, all are essential to students of American legal history"--Provided by publisher.

This book was released on 2021-10-26 with total page 434 pages. Available in PDF, EPUB and Kindle. Book excerpt: One of the finest historians of her generation, Jan Ellen Lewis (1949-2018) transformed our understanding of the early U.S. Republic. Her groundbreaking essays defined the emerging fields of gender and emotions history and reframed traditional understandings of the founding fathers and the U.S. Constitution. As significant as her work was within each of these subfields, her most remarkable insights came from the connections she drew among them. Gender and race, slavery and freedom, feelings and politics ran together in the hearts, minds, and lives of the men and women she studied. Lewis's brilliant research revealed these long-buried connections and illuminated their importance for America's past and present. Family, Slavery, and Love in the Early American Republic collects thirteen of Lewis's most important essays. Distinguished scholars shed light on the historical and historiographical contexts in which Lewis and her peers researched, wrote, and argued. But the real star of this volume is Lewis herself: confident, unconventional, erudite, and deeply imaginative.
