Deux étapes doivent être suivies.La première est une étape de qualification, consistant à élucider sa nature et son régime. Substantiellement, le bien est un objet tant économique que juridique : objet de valeur apte aux échanges, il est encore un objet dont la qualification dépend de considérations politiques. Objet juridique, le bien se résume plus fondamentalement au droit patrimonial. Tous les droits patrimoniaux – les biens – partagent un régime commun. Tous sont l’objet d’un rapport d’appartenance et d’une maîtrise semblable. Au cœur du régime des biens figure la titularité, unifiant le régime des biens.La seconde est une étape de classifications. L’unité des biens dans leur extériorisation ne saurait en effet faire oublier que les biens diffèrent les uns des autres par leur objet et leur contenu. Ce principe de classement permet de distinguer, à côté des droits réels et des droits personnels dont les contours sont redéfinis, la figure des droits d’exploitation, évoluant en marge de la distinction classique des droits patrimoniaux et dont les aspects se trouvent également présentés.
