Une harmonisation de la responsabilité est possible grâce à la causalité. Elle porte d'abord sur la délimitation de la responsabilité. Celle-ci étant fondée sur la causalité, qui est divisible, les régimes de délimitation et d'exonération de responsabilité doivent être revus. Elle impose ensuite de tracer ses frontières internes et externes. L'autonomie de la volonté peut déroger au principe de causalité. Une nouvelle frontière se dessine entre les deux ordres de responsabilité. La responsabilité contractuelle ne concerne que les situations pour lesquelles les parties ont expressément dérogé au principe de causalité. La responsabilité civile est de plus en plus utilisée pour garantir l'indemnisation du préjudice plus que la réparation du dommage. Les fonds d'indemnisation ainsi créés offrent une grande disparité de régimes. La causalité permet de classer ces fonds, dont l'harmonisation et l'arrêt de la prolifération pourraient être réalisés par la création de deux grands fonds, traçant une frontière externe nette avec la responsabilité.
