Book excerpt: In response to a congressional request, GAO reviewed the Environmental Protection Agency's (EPA) current progress in reviewing and controlling existing chemicals as mandated under the Toxic Substances Control Act. Since 1982, EPA has begun to make progress in implementing the existing chemicals program by establishing a process for identifying, assessing, and controlling existing chemical hazards. However, the chemicals program has had low priority in relation to other activities and, since fiscal year 1981, there has been a downward trend in funding for the program. EPA has begun to make progress in implementing the existing chemicals program by establishing a process for identifying, assessing, and controlling existing chemical hazards; developing a plan for implementing the program; and establishing an existing chemicals task force to develop, monitor, and manage the program. Since the act's passage, EPA has: (1) regulated 4 chemicals; (2) identified 60 chemicals that may present an unreasonable risk and need to be evaluated; and (3) determined that 41 additional chemicals require testing. Initially, EPA did not meet the act's mandate to initiate chemical test rulemaking proceedings within 1 year because of a lack of resources, and it had not proposed test rules. Finally, EPA has designated and assessed only two chemicals for 180-day priority review because those chemicals significantly increase the risk of harm from cancer, birth defects, or gene mutations.

This report determines the extent to which (1) EPA has made progress implementing its new approach and (2) EPA's new approach positions it to achieve its goal of ensuring the safety of chemicals. GAO examined agency documents and TSCA rulemaking and interviewed agency officials and stakeholders from industry and environmental organizations. "

GAO noted that: (1) because of high legal standards, EPA has issued regulations to control only nine chemicals since the enactment of TSCA; (2) extensive use of TSCA is not likely as long as EPA gives preference to other environmental laws that provide limits on emissions rather than restrictions on production; (3) TSCA chemical information-gathering and control authorities are difficult to use and ineffective; (4) EPA has assessed the risks of only about 2 percent of the chemicals in use; (5) EPA review processes do not ensure that the potential risks of new chemicals are fully assessed before they enter commerce; (6) EPA may not be able to improve its chemical review and control procedures without shifting more of the burden to the chemical industry; (7) much of the information on chemicals cannot be disseminated by EPA because it is confidential; and (8) although EPA has successfully challenged the validity of some confidentiality claims, it does not have the resources to challenge a significant portion of claims.
