GAO found that: (1) environmental cleanup at DOD government-owned, contractor-operated (GOCO) plants and the Rocky Mountain Arsenal will generally take longer and cost about $3 billion, 70 percent more that DOD reported; (2) liability for cleanup falls on a variety of potentially responsible parties, including facility operators and generators of hazardous substances; (3) each of the services and the Defense Logistics Agency has a different policy on cost-sharing for environmental cleanups; (4) Environmental Protection Agency policy states that status as a GOCO operator does not shield a contractor from environmental liability; (5) the military services have not requested that GOCO operators share in the cost of cleaning up past contamination; (6) cleanup is managed by the Army Corps of Engineers at former defense sites and former GOCO facilities sold to the private sector; and (7) a contribution of about $250 million has been obtained from the lessee at the Rocky Mountain Arsenal.

This is an increase from $465 billion in fiscal year 2017. DOD's fiscal year 2021 share of environmental liabilities was the second highest among federal agencies, at about $82 billion. Federal law authorizes DOD to identify, investigate, and clean up contamination from hazardous substances and military munitions that it caused on properties used for military purposes and that were conveyed out of DOD's jurisdiction prior to 1986. These types of contamination can harm both humans and the environment. . Among other objectives, this report (1) describes the scope and costs of cleaning up FUDS and the reliability of the estimates and (2) examines how DOD selects FUDS for cleanup. GAO recommends that DOD (1) develop guidance to weigh the relative risk between IRP and MMRP sites and (2) establish a relevant cleanup goal for the FUDS MMRP program.

Non-DOD parties such as private contractors or lessees that may have contributed to such contamination may also be responsible for the costs of cleanup at these sites. The Department and other responsible parties either agree to a cost sharing arrangement with the responsible parties conducting the cleanup or the Department conducts the cleanup and attempts to recover the other parties share after the cleanup. Previous reports identified wide variations in practices within the Department concerning attempts to recover non-DOD parties share of the costs of cleanups and recommended that the Department resolve these inconsistencies. Section 348 of the National Defense Authorization Act for Fiscal Year 1998 required the Department to issue guidance and collect data on cost recoveries. In response, the Department issued guidance that requires its components (the Army, Navy, Air Force, and Defense Logistics Agency) to identify, investigate, and pursue cost recoveries and to report on them in its Defense Environmental Restoration Program Annual Report to the Congress.

GAO found that: (1) as of September 1993, DOD has spent $3.76 billion on cleanups at its high priority sites, but its progress has been slow and relatively few sites have been cleaned up; (2) most DOD cleanup expenditures have been for environmental studies; (3) DOD estimates that it will cost $18.2 billion to clean up its 254 high priority installations, but actual costs will probably increase; (4) DOD has proposed revising its cleanup process to develop cooperative relationships with regulatory agencies, set up priorities based on risk, accelerate cleanups, increase management attention, and improve the environmental funding process; (5) the Environmental Protection Agency's (EPA) system for identifying DOD high priority sites for cleanup has led to a large number of installations being listed while some more contaminated unlisted sites pose a greater risk; (6) DOD must apply the entire cleanup process to all contaminated sites even if the contamination is minor; (7) for DOD to use its limited cleanup resources efficiently, DOD and EPA must evaluate the large number of DOD installations on the National Priorities List (NPL) and determine which are truly high priority; and (8) factors affecting DOD cleanup of high priority sites include the complex and time-consuming cleanup process, prolonged environmental studies, disagreements with regulatory agencies on the extent of cleanups, cleanup issues that do not pertain to government installations, and scarce resources.

GAO is not making any new recommendations in this report. Instead GAO is issuing another report concurrently (GAO-11- 364R) that describes in more detail some of the issues identified in this report, such as transparency in project costs and lack of a consistent design metric, and will make recommendations to address the issues.

Defense is required under the environmental restoration program to consult with EPA, which has its own authority to act at the site under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (sometimes referred to as "Superfund"). Under the program, Defense's activities must also be consistent with a statutory provision that addresses, among other things, participation by the affected states-in this case, the District of Columbia. Under the Corps' program guidance for FUDS, the District of Columbia has a role in defining the cleanup levels at the Spring Valley site. In carrying out their roles, the government entities have, over time, formed an active partnership to make cleanup decisions. For example, the Corps leads the effort to identify hazards, but in many cases it uses the recommendations of the District of Columbia and EPA to look for hazards buried at certain sites. While the entities have not agreed on all cleanup decisions, officials acknowledge that, by having formed a partnership, a means exists to foster communication and collaboration, and officials of all three entities stated that the partnership is operating effectively. Continued progress at the site will depend, in part, on the effectiveness of this partnership over the duration of the cleanup period.
