Book excerpt: In North America and Europe, cross-border governance arrangements have provided formal and informal frameworks to support cross-border cooperation. Analysing how these frameworks have emerged, the ways in which they have become institutionalized, and the processes by which they change is fundamental. Moreover, these frameworks are increasingly challenged by border securitization, thus limiting or jeopardizing decades of cross-border cooperative governance and coordinated public policies. Agents and Structures in Cross-Border Governance offers a series of case studies that explore these complex dynamics. To understand a range of cross-border governance frameworks, this collection addresses such topics as infrastructure development and management, resource sharing, regional politics, economics, security, human rights, the environment, culture, and community. The book explains how cross-border governance schemes have sought to mitigate some of the negative consequences of border security policies, allowing readers to discern how concrete national power struggles between federal/national and subnational governments unfold in border areas. In a world increasingly impacted by climate change and more recently the COVID-19 pandemic, Agents and Structures in Cross-Border Governance sheds light on the ongoing complexity of cross-border governance and offers lessons to help mitigate these challenges.

While global approaches may have long been sufficient in the past, the focus today is on how local dynamics can make inclusion possible. This two-volume collective work reports on these local dynamics, shedding light on how the creation of inclusive territories can be envisaged and developed. To this end, the involvement of public, private and associative organizations has been identified as one of the conditions for success. In fact, they act both as partners in a territory and as inclusive spaces. Inclusive Territories 1 examines the approaches implemented by several organizations that have made inclusion their wider objective.

Book excerpt: LES RESEAUX DE TELECOMMUNICATIONS SONT DEVENUS UN FACTEUR STRATEGIQUE AU SEIN DES GRANDES ENTREPRISES. LE RESEAU PEUT AUGMENTER LA FLEXIBILITE DE L'ORGANISME FACE AUX CHANGEMENTS DE L'ENVIRONNEMENT ET AMELIORER SES PERFORMANCES. MAIS CE GAIN DE FLEXIBILITE REPOSE SUR DES INVESTISSEMENTS TRES IMPORTANTS ET SUR LA CAPACITE DU RESEAU DE FOURNIR UN SERVICE DE TRES HAUTE QUALITE. UNE DEMARCHE ORGANISEE S'IMPOSE, MENANT DE LA REFLEXION STRATEGIQUE JUSQU'A LA MISE EN UVRE D'UNE ARCHITECTURE: LA PLANIFICATION DE RESEAUX D'ENTREPRISE. CONTRAIREMENT A LA PLANIFICATION DE RESEAUX PUBLICS, LA PLANIFICATION DE RESEAUX D'ENTREPRISE EST UNE ACTIVITE RECENTE QUI N'A PAS ENCORE DONNE LIEU A UNE RECHERCHE APPROFONDIE DE METHODES ET D'OUTILS. EN EFFET, UN EXPERT EN RESEAUX DISPOSE ACTUELLEMENT DE TRES PEU D'AIDE LORSQU'IL DOIT DEFINIR ET EVALUER L'ARCHITECTURE D'UN GRAND RESEAU D'ENTREPRISE. LE BUT DE CETTE THESE CONSISTE A COMBLER CETTE LACUNE. NOUS PROPOSONS LA METHODOLOGIE OPTINET PERMETTANT DE TRANSFORMER LE BESOIN D'ECHANGE D'INFORMATION DE L'ENTREPRISE EN DEFINITION D'UN SERVICE DE RESEAU APTE A VEHICULER LES DONNEES DE FACON EFFICACE. OPTINET COMPREND UNE METHODE DE MODELISATION ET UN OUTIL D'EVALUATION DE SCENARIOS D'ARCHITECTURE. LA METHODE PERMET DE FORMALISER LES DIFFERENTS TYPES DE FLUX D'INFORMATIONS (VOIX, DONNEES, IMAGE) CONDITIONNANT LE CHOIX DU RESEAU ET L'ENSEMBLE DES SERVICES QUI CONSTITUENT CE RESEAU. ELLE S'APPUIE SUR UN META-MODELE QUI ADOPTE, CONTRAIREMENT A LA PLUPART DES METHODES DE PLANIFICATION EXISTANTES, UNE VUE DU RESEAU QUI EST ORIENTEE VERS L'ENTREPRISE ET NON PAS VERS L'OPERATEUR. EN PARTICULIER, L'INTRODUCTION DE LA NOTION DE FLUX, UTILISEE A LA PLACE DES MATRICES DE TRAFIC TRADITIONNELLES, PERMET UNE REPRESENTATION DE L'ENSEMBLE DES CARACTERISTIQUES ET DES CONTRAINTES DES ECHANGES. DE PLUS, NOUS AVONS ADOPTE DES PRINCIPES DE MODELISATION QUI ASSURENT LA FLEXIBILITE DU MODELE FACE AUX NOMBREUX CHANGEMENTS RENCONTRES TYPIQUEMENT DANS UNE ENTREPRISE (AUGMENTATION DE L'ACTIVITE DE L'ENTREPRISE, DEPLACEMENT D'APPLICATIONS, CHANGEMENT DE TARIFS...). LA MODELISATION DU RESEAU REPOSE SUR DES CONCEPTS CONNUS DANS LES METHODES DE SYSTEME D'INFORMATION (SI). CELA NOUS A PERMIS DE FAIRE APPEL A UNE REPRESENTATION COMPREHENSIBLE DE LA SEMANTIQUE DE L'ENTREPRISE SOUS FORME D'ENTITES ET DE RELATIONS. EN EFFET, LES METHODES DE SI APPORTENT UNE VUE ORGANISATIONNELLE QUI, A NOTRE AVIS, EST SOUVENT SOUS-ESTIMEE OU OUBLIEE DANS LA CONCEPTION DE RESEAUX. L'OUTIL PERMET D'EVALUER LES CRITERES QUANTITATIFS QUI INTERVIENNENT EN PREMIER LIEU DANS LES DECISIONS D'UN EXPERT RESEAU: LES COUTS ET LE DIMENSIONNEMENT. CONTRAIREMENT AUX OUTILS DE RESEAUX EXISTANTS, PEU FLEXIBLES ET ORIENTES VERS L'EVALUATION PRECISE DES PERFORMANCES, L'OUTIL OPTINET PEUT S'ADAPTER A DES CONTRAINTES ORGANISATIONNELLES ET TECHNIQUES TRES SPECIFIQUES A UNE ENTREPRISE DONNEE. L'EMPLOI DE LA TECHNOLOGIE PAR OBJET, ET EN PARTICULIER DU LANGAGE OBJET EIFFEL, PERMET DE PROGRAMMER RAPIDEMENT UN NOUVEAU SCENARIO TOUT EN ASSURANT LA FIABILITE DE L'APPLICATION. NOUS AVONS OBSERVE UN TAUX DE REUTILISABILITE DE CLASSES ENTRE 80 ET 90% EN PASSANT D'UN SCENARIO (OU ENTREPRISE) A UN NOUVEAU CAS D'ETUDE. LA METHODOLOGIE A ETE VALIDEE EN L'APPLIQUANT A L'OPTIMISATION TECHNICO-ECONOMIQUE DU RESEAU NATIONAL D'UNE GRANDE BANQUE (4000 SITES), ET A L CONCEPTION DU RESEAU DE TRANSPORT D'UN GROUPE INDUSTRIEL DU SECTEUR PETROCHIMIQUE.

Book excerpt: Georges Abi-Saab began his writing and teaching at a time when the process of decolonization, and thereafter the quest for emancipation, began to make its far-reaching impact on the international scene, producing significant changes in the international environment, both quantitatively in increasing the number of nation-States and qualitatively in changing patterns of interests and claims. This was bound to result in new pressures on the international legal system itself and in a questioning of the traditional Eurocentric content of international law. In his work and teaching Professor Abi-Saab viewed the dynamics of international law as a function of two driving forces: the emergence of the third world and the sense of injustice. In his view, the first driving force - the emergence of the third world - raised the problem of exclusion: exclusion from participation in the elaboration of international law and the decision-making process, and exclusion as beneficiaries of the resulting rules of international law. At the same time, this new force introduced diversity into the international scene, reflecting the richness of the international community in its different facets. This process remains relevant today, reflecting the contemporary problem of exclusion of new actors as well as their quest for participation. The second driving force - the sense of injustice - posed a teleological problem for him, that of defining community values in order that they capture the different facets of justice, whether formal or distributive. So long as there is no effective organic structure, international law in his view will continue to remain effectiveness-oriented, reflecting rather than impacting on the structures of power. Nevertheless, it is undeniable that there is an on-going process of development of community values and interests; as Georges Abi-Saab wrote with reference to international crimes: `law, like all social phenomena, is a continuous unfolding, a continuous process of elaboration'. He has also considered that the dynamics of the international legal process itself can be captured from the perspective of international organizations as vehicles for change in the international system. From his early writings, Georges Abi-Saab approached the United Nations Charter as a blueprint - both normative and institutional - for a certain type of international society. International institutions with all their imperfections, continue for him to be the means of realization of the law of cooperation which lies at the heart of his concept of the international system. The themes selected for this volume in honour of Professor Georges Abi-Saab are intended to reflect his unique and pioneering contribution to the field of international law. The contributors are drawn from what he has always considered to be his large `family' of former students: in his forty years of teaching, Georges Abi-Saab has acted as mentor to generations of students from all over the world who have benefited from his vision, insights, originality and creative and stimulating use of language. The contributors also include colleagues and friends who share a similar vision of the international legal system.

Mediation and related third party interventions such as conciliation and facilitation are discussed as effective prevention and regulation tools for different types of collective labor conflicts. These interventions fit in a new developed five-phase model of collective conflicts in organizations, going from capacity building in latent conflicts, through conciliation, mediation and arbitration in escalating phases, to rebuilding of trust after hot conflicts. The authors promote understanding and discussion with regards to labor mediation systems, presenting comparative research on the perspectives of mediators and users of mediation. This book describes and analyses laws, regulations and practices of mediation in seventeen countries, with a relative strong emphasis on Europe. Part 1 presents theoretical frameworks on conciliation and mediation in collective labor conflicts. Part 2 presents regulations and practices in 12 European countries: Belgium, Denmark, Estonia, France, Italy, Poland, Portugal, Spain, The Netherlands, and the United Kingdom. Part 3 discusses mediation in these collective conflicts in Australia, China, India, South Africa and the USA. Part 4 offers conclusions and ways forward. This book offers analyses, good practices and developments for third party intervention in collective labor conflicts in global and local changing environments. This book is a must-read for policy makers, , social partners at different levels, as well as scholars and practitioners in industrial relations, human resources management and conflict management, particularly conciliators and mediators.
