Book excerpt: Investigating the principle of reasona-bleness in the legal world requires—if the task is to be taken seriously—to take a journey directly to the roots of the concept of law and to the ultimate paradigms that inform its knowledge, just to find the beginning of a different and maybe harder path, heading to the idea of reason. The essays presented in this book do not aim to complete such journeys, but just to take some modest steps into them. Many con-cepts are thereby found, many more are left to be investigated. Meanwhile, between rationality and reasonableness, theory and practice, science and prudence, episteme and phronesis, a global need emerges: that to keep addressing the core of the ‘Rule of Reason’ in the law.

Available in PDF, EPUB and Kindle. Book excerpt: What this book intends to do is to study three-dimensionalism (the distinction values-norms-facts) not in what could be called its historical dimension, but in its substantive aspect, as a “form” that, when applied to different legal themes, would add a “material content” to the three-dimensional theory. We can point out, as a study plan, the distinction between “three” perspectives: Those of the legal norm, of the legal order, and the legal relationship. Three-dimensionalism also appears in this work when one analyzes the “three” phases of the life of the law: The formation, the interpretation, and the application; and in the distinction between the “three” characteristics of the legal order: Fullness, coherence, and unity—the theory of legal validity, intended as legitimacy, as validity strictly speaking, or as effectiveness.

Available in PDF, EPUB and Kindle. Book excerpt: Modern liberal societies are submerged in conflict and disagreement. People disagree about almost everything—not only about matters of justice, but also about issues that are more private. They disagree on how to interpret freedom and equality; they disagree and even experience conflict with issues regarding the use of a veil, or children wearing crucifixes in public spaces; they also enter into conflict and disagreement regarding issues such as homosexuality, extramarital sex, drugs, euthanasia, abortion, suicide, and experimentation on animals. All these issues can be understood as moral problems, but we also have disagreements concerning other topics that are unrelated to moral issues. For modern liberals, the existence of such conflicts is due to the possibility of people, bearing the right to disagree, expressing themselves in a free and equal way. This freedom is indeed one of the biggest triumphs in the history of liberalism: many societies have come to be constituted by autonomous and free individuals who have the capacity to choose their lives and the values that will guide them. In the middle of this panorama, tolerance plays an extremely important role for liberal thinking. Without tolerance, disagreements and conflicts will hardly coexist or be resolved in a peaceful manner. Liberals say that despite the fact that there is a plurality of values and diversity within the different lifestyles, we should tolerate all those who do not agree with our own values. On this view, tolerance becomes a key element for the flourishing and progression of moral life. Yet, liberals should ask themselves: is modern liberalism’s structure of practical reason compatible with the moral ideal of tolerance? René González de la Vega argues that liberal deontological theories cannot give proper answers to the main problems raised by the moral ideal of tolerance. Tolerance and Modern Liberalism: From Paradox to Aretaic Moral Ideal will be of interest to students and scholars of political and moral philosophy, political theory, and law, including those who focus on human rights and on deontological liberalism.

Available in PDF, EPUB and Kindle. Book excerpt: This book intertwines two major themes in contemporary legal theory – the concepts of human dignity and the problem of the autonomy and limits of the law – while also addressing two other key aspects – the first one concerned with human rights practices and foundations (in their direct connections with the issue of dignity), the second one considering the role that the law’s aspirations attribute to the experience of an autonomous subject-person (and the demands that identify his/her position in the dialectical counterpoint with the rethinking of a community). The diversity of perspectives that each of these themes allows is explored in various contexts and with unmistakable implications concerning juridical validity, rule of law practices, pluralism, political and practical-cultural challenges, and divisive “bio-ethical” issues. This means considering the separation or separability theses between law and morality and the juridically relevant experience of person(hood) as a dialectic between autonomy and responsibility, the orthodox and heterodox images of comparable concreteness and incomparable singularity, the challenges of external points of view and interdisciplinary approaches.

Book excerpt: This volume offers different perspectives on judicial practice in the European and American contexts, both arguably characterized in the last decades by the emergence of novel normative and even policy arguments by judges. The central question deserving the attention of the contributors concerns the degree in which judicial exercises in practical reasoning may amount to forms of judicial usurpation of the legislative function by courts. Since different views as to the nature and scope of legal reasoning lead to different degrees of tolerance regarding what should be admissible to courts, that same nature and scope is thoroughly debated. The main disciplinary approach is that of general jurisprudence, but the contributions take stock of other disciplines in which judicial activism has been addressed, namely positive theories of judicial behavior. Accordingly, the book also explores the development of interdisciplinary dialogue about the theme.

Book excerpt: A key intermediary between courts and the public are the journalists who monitor the actions of justices and report their decisions, pronouncements, and proclivities. Justices and Journalists: The Global Perspective is the first volume of its kind - a comparative analysis of the relationship between supreme courts and the press who cover them. Understanding this relationship is critical in a digital media age when government transparency is increasingly demanded by the public and judicial actions are the subject of press and public scrutiny. Richard Davis and David Taras take a comparative look at how justices in countries around the world relate to the media, the interactive points between the courts and the press, the roles of television and the digital media, and the future of the relationship.

By building on the idea that there are various - and many times contradictory - interpretations of peace in history and culture, this book examines how these many forms of peace interplay in legal spheres, shaping legal discourses and practices - concretely those concerning the exercise of rights. By arguing that different perspectives on peace influence different argumentations of rights, the book challenges some of the political and legal discourses framed within the war against terror since 2001 and the resulting militarization of the Colombian society and its rights discourses.
