It does not purport to deal with the Scotch or Irish land systems, in so far as they differ from the English, except where these differences may be significant, for purposes of illustration. Nor does it purport to describe fully the land systems of foreign countries, though I have thought it well to introduce a concise review of the more important among these, in order to exhibit in stronger relief the unique character of the agrarian constitution established in England by the joint operation of Law and Custom. The peculiar essence of that constitution is to be found in the marked separation of the agricultural community into three classes - landlords, farmers, and labourers. Of these classes, the first is at once the most powerful, and the most typical product of the English Land System. I have, therefore, associated "English Land" with "English Landlords," in the title of a work chiefly designed to set forth the reciprocal influence of social and agricultural relations in the past, the present, and the future. Who has not been a landlord or a tenant? It is one of the most common legal relationships between people, and has been since the medieval period. But there is very little academic interest in the law of landlord and tenant. Nobody before has attempted to write its history. This book shows how the rules on each point of importance have developed. Sometimes it demonstrates how a wrong turn has been taken, or an important principle forgotten. But its practical use is to provide the material for understanding the old cases, and to put those cases in their proper context; for it is hard for any lawyer, advising on a doubtful point, to say where exactly we are now, without a thorough understanding of what the law once was and how and when it might have changed. The historical development of the rules about granting leases, their different types, the rents, covenants and conditions which can be attached to them, their alienation and termination, and the forms of action used to enforce them, are all explained in this book. MARK WONNACOTT is a barrister at Maitland Chambers in Lincoln's Inn, London, specialising in property litigation. If it is attached to the ground, he litigates about it, and the dustier corners of land law are his particular favourite. He was counsel for the successful appellant in Berrisford v. Mexfield Housing Co-operative Ltd. [2011] UKSC 52, which revived the rule that a tenancy for an uncertain term is a defeasible lease for life. When not in court or writing law-books, he is collecting or repairing them, or trying to learn Italian, without much success, or appreciating wine, with somewhat more success. For instance, the Education rate may properly be considered a tax for national purposes, and it is somewhat hard that landowners and farmers, in common with other employers, should bear so large a proportion of it, while they are prohibited from employing the cheap labour of children, and compelled to pay a higher scale of wages to adults. But such demands cannot fairly be adjusted to B's income by strict arithmetical rules; still less would it be fair to shift upon his shoulders a great part of A's burdens, without regard for vested interests. For it must not be forgotten that men's rights are to be measured, to some extent, by the expectations which the law has encouraged. A and B may have started in life with equal fortunes, but with different ambitions. The former, preferring the dignity of a landowner to a large income, may have bought a country place with a full appreciation of the privileges and liabilities attaching to it. The latter, preferring the consolations of wealth to a county position, may have gone into business and be satisfied to live in a villa, with the pleasing assurance that his gains will scarcely be touched by the ratecollector. The ambition of A may be the nobler and more generous, but that is no reason why, having realised the object of it, he should call upon B to share with him the pecuniary sacrifices which it entails. This consideration brings into view that which is, in fact, one main justification for the "peculiar burdens of land...".
