Exploiting variation in enforcement capacity across the Russian Federation's administrative regions, this paper examines whether the enforcement of restrictive regulations on hiring and firing workers affects how firms adjust employment during industry upswings and downswings. The analysis finds that the extent to which firms adjust employment upward during industry upswings and downward during downswings is smaller in regions with stronger enforcement capacity (or stricter de facto employment protection). The effect of enforcement is sizable: for example, increasing enforcement capacity from the 25th to the 75th percentile dampens employment adjustment in a downswing by 34 percent. Thus, although restrictive regulation on hiring and firing reduces the ability of firms to adjust employment, the extent to which it does so depends on enforcement.

Does the informal sector introduce greater de facto flexibility, reducing employment losses during bad times? To tackle these questions, we exploit local economic shocks generated by trade liberalization and variation in enforcement capacity across local labor markets in Brazil. In the aftermath of the trade opening, regions with stricter enforcement observed: (i) lower informality effects; (ii) larger losses in overall employment; and (iii) greater reductions in the number of formal plants. Regions with weaker enforcement observed opposite effects. All these effects are concentrated on low-skill workers. Our results indicate that greater de facto labor market flexibility introduced by informality allows both formal firms and low-skill workers to cope better with adverse labor market shocks.

The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. Occupational Safety and Health (OSH) committees are considered the key worker voice institution through which to improve workplace safety and health (ILO, 1981). I present evidence of these committees’ causal effects on workers and on factories. To do so, I collaborated with 29 multinational apparel buyers that committed to enforce a local mandate for OSH committees on their suppliers in Bangladesh. With the buyers, I implemented a nearly year-long field experiment with 84 supplier factories, randomly enforcing the mandate on half. The buyers’ intervention increased compliance with the OSH committee law. Exploiting the experimental variation in OSH committees’ strength, I find that stronger OSH committees improved objective measures of safety. These improvements did not come at a cost to workers in terms of wages or employment or to factories in terms of labor productivity. The effects on compliance, safety, and voice were largest for factories with better managerial practices. Factories with worse practices did not improve, and workers in these factories reported lower job satisfaction; this finding suggests complementarity between external enforcement and internal managerial capacity in determining the efficacy of regulation.
