Book excerpt: The Law Library presents the complete text of the Endangered and Threatened Species - Removal of the Puget Sound - Georgia Basin Distinct Population Segment of Canary Rockfish (US National Oceanic and Atmospheric Administration Regulation) (NOAA) (2018 Edition). Updated as of May 29, 2018 We, NMFS, are issuing a final rule to remove the Puget Sound/Georgia Basin canary rockfish (Sebastes pinniger) Distinct Population Segment (DPS) from the Federal List of Threatened and Endangered Species and remove its critical habitat designation. We proposed these actions based on newly obtained samples and genetic analysis that demonstrates that the Puget Sound/Georgia Basin canary rockfish population does not meet the DPS criteria and therefore does not qualify for listing under the Endangered Species Act (ESA). Following public and peer review of the proposed rule and supporting scientific information, this final rule implements the changes to the listing and critical habitat for canary rockfish. This ebook contains: - The complete text of the Endangered and Threatened Species - Removal of the Puget Sound - Georgia Basin Distinct Population Segment of Canary Rockfish (US National Oceanic and Atmospheric Administration Regulation) (NOAA) (2018 Edition) - A dynamic table of content linking to each section - A table of contents in introduction presenting a general overview of the structure

Book excerpt: The Law Library presents the complete text of the Endangered and Threatened Species - Puget Sound - Georgia Basin Distinct Population Segments of Yelloweye Rockfish, Canary Rockfish and Bocaccio (US National Oceanic and Atmospheric Administration Regulation) (NOAA) (2018 Edition). Updated as of May 29, 2018 We, the National Marine Fisheries Service (NMFS), issue a final rule to designate critical habitat for three species of rockfish listed under the Endangered Species Act (ESA): the threatened yelloweye rockfish (Sebastes ruberrimus) Distinct Population Segment (DPS), the threatened canary rockfish (S. pinniger) DPS, and the endangered bocaccio (S. paucispinus) DPS (listed rockfish) pursuant to section 4 of the ESA. The specific areas in the final designation include 590.4 square miles (1529 square km) of nearshore habitat for canary rockfish and bocaccio, and 414.1 square miles (1072.5 square km) of deepwater habitat for yelloweye rockfish, canary rockfish and bocaccio. This final designation represents a reduction of approximately 15.2 percent (180.3 sq mi, 467 sq km) for canary rockfish and bocaccio, and a reduction of approximately 28 percent (160 sq mi, 416.2 sq km) for yelloweye rockfish, compared to our proposed critical habitat rule on August 6, 2013 (78 FR 47635). We exclude some particular areas from designation because the benefits of exclusion outweigh the benefits of inclusion and exclusion of those areas will not result in the extinction of the species. No areas were excluded based on economic impacts. Book excerpt: "This final Environmental Assessment (EA) is for NMFS's issuance of section 10 of the Endangered Species Act (ESA) permits to WDFW for take due to scientific research and fisheries management of ESA-listed rockfish and other listed fish within the Puget Sound/Georgia Basin. NMFS has conducted this environmental review under the National Environmental Policy Act in support of evaluating WDFW's permit applications under section 10 of the ESA. The EA evaluates the environmental consequences of alternative actions for issuing incidental take permits to WDFW for scientific research and fisheries management in the Puget Sound/Georgia Basin. The analysis of alternatives and consequences will inform NMFS' decision regarding issuance of these section 10 permits. The covered species for these permits would include the Puget Sound/Georgia Basin DPSs of threatened yelloweye rockfish, canary rockfish, and endangered bocaccio. Additional covered species would include the threatened Evolutionarily Significant Units of Puget Sound Chinook salmon (Oncorhynchus tshawytscha), Puget Sound summer chum salmon (O. keta) and, the threatened DPS of Puget Sound steelhead (O. omykiss), and the threatened DPSs of southern green sturgeon (Acipenser medirostris) and southern eulachon (Thaleichthys pacificus)"--Executive Summary (page ES-1).

Updated as of May 29, 2018 We, NMFS, issue a final rule to list two foreign marine guitarfish species under the Endangered Species Act (ESA). We considered comments submitted on the proposed listing rule and have determined that the blackchin guitarfish (Rhinobatos cemiculus) and common guitarfish (Rhinobatos rhinobatos) warrant listing as threatened species. We will not designate critical habitat for either of these species because the geographical areas occupied by these species are entirely outside U.S. jurisdiction, and we have not identified any unoccupied areas within U.S. jurisdiction that are currently essential to the conservation of either of these species. Book excerpt: The Law Library presents the complete text of the Endangered and Threatened Species - Designation of Nonessential Experimental Population for Middle Columbia River Steelhead, etc. (US National Oceanic and Atmospheric Administration Regulation) (NOAA) (2018 Edition). Updated as of May 29, 2018 We, the National Marine Fisheries Service (NMFS), are issuing a final rule to authorize the continued release of Middle Columbia River (MCR) steelhead (Oncorhynchus mykiss) that are currently being reintroduced as part of an ongoing reintroduction effort into the upper Deschutes River basin in portions of Jefferson, Crook, and Deschutes Counties, Oregon, and designate them as a nonessential experimental population (NEP) under the Endangered Species Act (ESA) of 1973. The geographic boundaries of the NEP extend upstream from Round Butte Dam on the Deschutes River (about river mile (RM) 110, river kilometer (rkm) 177) and all accessible reaches of the Deschutes River and its tributary Whychus Creek; on the Crooked River from its confluence with the Deschutes River upstream to Bowman Dam (RM 70, rkm 113) and all accessible tributaries between these points; and on the Metolius River from its confluence with the Deschutes River upstream to all accessible tributaries between these points. This NEP designation will have an expiration date 12 years from the effective date of this final rule. We anticipate providing a notice in the Federal Register about 1 year before the NEP designation is set to expire to provide adequate notice to the public. Book excerpt: The Law Library presents the complete text of the Endangered and Threatened Species - Designation of Critical Habitat for Cook Inlet Beluga Whale (US National Oceanic and Atmospheric Administration Regulation) (NOAA) (2018 Edition). Updated as of May 29, 2018 We, the National Marine Fisheries Service (NMFS), designate critical habitat for the Cook Inlet beluga whale (Delphinapterus leucas) distinct population segment (DPS) under the Endangered Species Act (ESA). Two areas are designated, comprising 7,800 square kilometers (3,013 square miles) of marine habitat. In developing this final rule we considered public and peer review comments, as well as economic impacts and impacts to national security. We have decided in the final rule to exclude the Port of Anchorage (POA) in consideration of national security interest. Additionally, consistent with the proposed rule, portions of military lands were determined to be ineligible for designation as critical habitat. We solicited comments from the public on all aspects of the proposed rule, and conducted four public hearings on the action. Along with the proposed rule, we published a draft economic impacts analysis, entitled "Draft RIR/4(b)(2) Preparatory Assessment/IFRA for the Critical Habitat Designation of Cook Inlet Beluga Whale." This economic analysis has been completed to support the final designation. See "Final RIR/4(b)(2) Preparatory Assessment/FRFA for the Critical Habitat Designation of Cook Inlet Beluga Whale" for a discussion of these topics. Book excerpt: The Law Library presents the complete text of the Endangered and Threatened Wildlife and Plants - Nassau Grouper - Final Listing Determination on Proposal to List as Threatened (US National Oceanic and Atmospheric Administration Regulation) (NOAA) (2018 Edition). Updated as of May 29, 2018 We, NMFS, are publishing this final rule to implement our determination to list the Nassau grouper (Epinephelus striatus) as threatened under the Endangered Species Act of 1973, as amended (ESA). We have completed a status review of the Nassau grouper in response to a petition submitted by WildEarth Guardians. After reviewing the best scientific and commercial data available, including the status review and comments received on the proposed rule, we have determined that the Nassau grouper meets the definition of a threatened species. While the species still occupies its historical range, overutilization through historical harvest has reduced the number of individuals which in turn has reduced the number and size of spawning aggregations. Although harvest of Nassau grouper has diminished due to management measures, the reduced number and size of spawning aggregations and the inadequacy of law enforcement continue to present extinction risk to Nassau grouper. Based on these considerations, described in more detail within this action, we conclude that the Nassau grouper is not currently in danger of extinction throughout all or a significant portion of its range, but is likely to become so within the foreseeable future. We also solicit information that may be relevant to the designation of critical habitat for Nassau grouper, including information on physical or biological features essential to the species' conservation, areas containing these features, and potential impacts of a designation. Updated as of May 29, 2018 In response to a petition, we, NMFS, issue a final rule to list the Banggai cardinalfish (Pterapogon kauderni) as a threatened species under the Endangered Species Act (ESA). We have also determined that the proposed listing of Harrisson's dogfish shark (Centrophorus harrissoni) as a threatened species is not warranted at this time. Updated as of May 29, 2018 We, NMFS, issue this final rule implementing our determination that the narrow sawfish (Anoxypristis cuspidata), dwarf sawfish (Pristis clavata), largetooth sawfish (collectively Pristis pristis; formerly Pristis pristis, Pristis microdon, and Pristis perotteti), green sawfish (Pristis zijsron), and the non-U.S. distinct population segment (DPS) of smalltooth sawfish (Pristis pectinata) are endangered species under the Endangered Species Act (ESA) of 1973, as amended. We also include a change in the scientific name for largetooth sawfish in this final rule to codify the taxonomic reclassification of P. perotteti to P. pristis. We are not designating critical habitat because the geographical areas occupied by the species are entirely outside U.S. jurisdiction and we have not identified any unoccupied areas within U.S. jurisdiction that are essential to the conservation of any of the five species. We have reviewed the status of the five species of sawfish, considered public and peer review comments, and conservation efforts being made to protect all five species, and we have made our determination based on the best available scientific and commercial data that all five species of sawfish-the narrow sawfish (Anoxypristis cuspidata), dwarf sawfish (Pristis clavata), largetooth sawfish (collectively Pristis pristis; formerly Pristis pristis, Pristis microdon, and Pristis perotteti), green sawfish (Pristis zijsron), and the non-U.S. DPS of smalltooth sawfish (Pristis pectinata)-are at risk of extinction throughout all of their ranges and should be listed as endangered species. This ebook contains: - The complete text of the Endangered and Threatened Wildlife and Plants - Final Endangered Listing of Five Species of Sawfish (US National Oceanic and Atmospheric Administration Regulation) (NOAA) (2018 Edition) - A dynamic table of content linking to each section - A table of contents in introduction presenting a general overview of the structure

Book excerpt: "This Recovery Plan serves as a blueprint for the protection and recovery of the southern Distinct Population Segment (DPS) of eulachon (Thaleichthys pacificus) using the best available science per the requirements of the Endangered Species Act (ESA). The Recovery Plan links threats and management actions to an active research program to fill data gaps, and a monitoring program to assess these actions' effectiveness. Research and monitoring results will provide information to refine ongoing actions and prioritize new actions to achieve the Plan's goal: to restore the listed species to the point where it no longer requires the protections of the ESA"--Introduction.
