Book Synopsis Causing Psychiatric and Emotional Harm by : Harvey Teff
Download or read book Causing Psychiatric and Emotional Harm written by Harvey Teff and published by Bloomsbury Publishing. This book was released on 2008-12-18 with total page 228 pages. Available in PDF, EPUB and Kindle. Book excerpt: Though mental harm can be profoundly disabling, the law imposes strict limits on who can recover damages for it. In the absence of physical injury, compensation is not normally available for negligently caused mental suffering, however severe, unless it constitutes a 'recognisable psychiatric illness'. Claimants whose mental trauma stems from injury caused to someone else are subject to arbitrary restrictive liability rules that dispense with established legal principles and cannot be reconciled with scientific advances. The book traces the history of civil liability for mental harm up to the present day. It is argued that the reluctance to provide redress reflects an enduring suspicion of intangible injury and undue fear of proliferating claims. The scale and legal ramifications of the Hillsborough disaster; the emergence of claims arising from work-related stress, and other new categories of claims based mainly on prior relationships between the parties, have all added to a 'floodgates fear' that has intensified due to popular perceptions of a 'compensation culture'. The book contrasts the limited scope for liability under English law with developments in several other jurisdictions. It is argued that statutory reform is needed to achieve greater legal coherence and to provide a remedy that tracks the impact and severity of harm and is not confined to psychiatric disorders. A new legal framework is offered, rooted in reasonable foreseeability of mental or emotional harm, with a liability threshold of 'moderate severity'. To allay concerns about proliferating claims, modifications to the compensatory regime for personal injury are proposed.

Book Synopsis Sound and Noise by : Marcia Jenneth Epstein
Download or read book Sound and Noise written by Marcia Jenneth Epstein and published by McGill-Queen's Press - MQUP. This book was released on 2020-10-30 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is about how you listen and what you hear, about how to have a dialogue with the sounds around you. Marcia Jenneth Epstein gives readers the impetus and the tools to understand the sounds and noise that define their daily lives in this groundbreaking interdisciplinary study of how auditory stimuli impact both individuals and communities. Epstein employs scientific and sociological perspectives to examine noise in multiple contexts: as a threat to health and peace of mind, as a motivator for social cohesion, as a potent form of communication and expression of power. She draws on a massive base of specialist literature from fields as diverse as nursing and neuroscience, sociology and sound studies, acoustic ecology and urban planning, engineering, anthropology, and musicology, among others, synthesizing and explaining these findings to evaluate the ubiquitous effects of sound in everyday life. Epstein investigates speech and music as well as noise and explores their physical and cultural dimensions. Ultimately she argues for an engaged public dialogue on sound, built on a shared foundation of critical listening, and provides the understanding for all of us to speak and be heard in such a discussion. Sound and Noise is a timely evaluation of the noise that surrounds us, how we hear it, and what we can do about it.

Book Synopsis Expectancy and emotion by : Maria Miceli
Download or read book Expectancy and emotion written by Maria Miceli and published by OUP Oxford. This book was released on 2014-11-27 with total page 319 pages. Available in PDF, EPUB and Kindle. Book excerpt: The mind is a powerful anticipatory device. It frequently makes predictions about the future, telling us not only how the world might or will be, but also how it should be - or better - how we would like it to be. These expectancies shape our lives: they impact on our actual outcomes, often acting as self-fulfilling prophecies. They also constitute a reference point for establishing whether an outcome is a loss or a gain; that is, we evaluate our own outcomes not in absolute terms, but against our expectancies. And we feel ill-treated and betrayed when our expectancies are disappointed. This book explores anticipation-based emotions, that is, the emotions associated with the dialectical interaction between 'what is' and 'what is not (yet)', be it a mere wished-for possibility or an expectation proper. It offers an analysis of both the emotions implying anticipations of future events - such as fear, anxiety, hope, and trust - and those elicited by the disconfirmation of a previous anticipation - surprise, disappointment, discouragement, sense of injustice, regret, and relief - in terms of their belief and goal components. In addition, it addresses anticipated emotions, that is, emotions we think we might experience in future circumstances, and explores how they influence our decisions. The reader will be taken on a journey of exploration and discovery into the multifarious facets and implications of an important family of emotions, aimed at understanding what they have in common, as well as the distinguishing features of each distinct emotion, and predicting their motivational and behavioral consequences. For students and researchers interested in the affective sciences, including psychology, philosophy, and neuroscience, this is a highly original and thought provoking new work.
