Book excerpt: This is the first known analysis of U.S. Army emergency medical services malpractice claims. From 1979 to 2005, 501 claims were ultimately paid in the form of settlements and judgments totaling nearly 125 million. Payments were made in nearly 60% of 20 claims filed annually. Almost 50% of claimants experienced some degree of permanent disability or died. Children represented nearly twice the percentage of claimants found in previously published Department of Defense data. Since September 1, 1990, 442 U.S. Army health care providers have been reported to the National Practitioner Data Bank, including 13 emergency physicians. Nearly 78 million were paid in 122 claims without a documented breach of the standard of care in the Centralized Credentials Quality Assurance System. This represents an area warranting further study and possible changes in the claims review or database management processes. The fact that over 50% of U.S. emergency department visits are for emergent and urgent conditions questions the commonly held belief that most emergency department patients should be seen in primary care settings. Implementing effective interpersonal communication skills training and promoting timely disclosure of medical errors are appropriate. Emergency medical services, along with law enforcement and fire departments deserve the staffing, funding, and support commensurate with each community’s demand for these critical services. Emergency medicine has unique characteristics that enable errors to occur. It is not possible to completely eliminate the possibility of error in emergency medicine; however, organizational quality improvement and risk management strategies should be implemented in consultation with knowledgeable emergency services providers who are dedicated to improving the safety of emergency medical services systems.
