Book excerpt: The defendant Wiley Spear was indebted to John Spear, his son, to the amount of [dollars] 2,025, and so executed to him forty-five promissory notes for [dollars] 45 each. John Spear subsequently sold the notes to the plaintiff Elmore. Before the notes became due, Wiley Spear fled Georgia for parts unknown. Before he left he placed in the hands of Samuel Strong, also a defendant, ten slaves to sell; these were worth [dollars] 3,600. Some of the slaves were subsequently sold by Strong to one Davis Gamage, a dealer in slaves and also a defendant, from whom Elmore claimed them in this bill. Gamage answered that he had bought three slaves bona fide from Wiley Spear for [dollars] 1,100, whom he had since sold on, and knew nothing of any indebtedness of Spear's. The lower court ordered that Elmore amend his bill to make the other creditors of Wiley Spear parties complainants, to which he excepted. The Supreme Court reversed this judgment.
