Available in PDF, EPUB and Kindle. Book excerpt: This book explores the whole of the large and controversial subject of the use of force in international law; it examines not only the use of force by states but also the role of the UN in peacekeeping and enforcement action, and the growing importance of regional organizations in the maintenance of international peace and security. Since the publication of the second edition of International Law and the Use of Force the law in this area has continued to undergo a fundamental reappraisal. Operation Enduring Freedom carries on against Al Qaida and the Taliban in Afghanistan six years after the terrorist attacks of 11 September 2001. Can this still be justified as self-defence in the 'war on terror'? Is there now a wide right of pre-emptive self-defence against armed attacks by non-state actors? The 2006 Israel/Lebanon conflict and the recent intervention of Ethiopia in Somalia raise questions about whether the 'war on terror' has brought major changes in the law on self-defence and on regime change. The 2003 invasion of Iraq gave rise to serious divisions between states as to the legality of this use of force and to talk of a crisis of collective security for the UN. In response the UN initiated major reports on the future of the Charter system; these rejected amendment of the Charter provisions on the use of force. They also rejected any right of pre-emptive self-defence. They advocated a 'responsibility to protect' in cases of genocide or massive violations of human rights; the events in Darfur show the practical difficulties with the implementation of such a duty.

Available in PDF, EPUB and Kindle. Book excerpt: Since 1985, the Law School at the University of Hull has hosted an annual lecture - the Josephine Onoh Memorial Lecture - given by a distinguished international lawyer. These annual lectures are funded by the Josephine Onoh Memorial Fund, established in 1984 by the family and friends of Josephine Onoh who was tragically killed in an air crash at Enugu, Nigeria, in November 1983. Josephine was a Hull law graduate, and at the time of her death was registered at the University for a research degree in the field of international law. This book contains a collection of these annual lectures. The first lecture in 1985 was given by the late Judge Taslim Elias, at that time President of the International Court of Justice. Subsequent lectures have been given by both leading practitioners and professors of international law, including Sir Robert Jennings, Bin Cheng, Sir Ian Sinclair, Philip Allott, Henry Schermers, Lord Mackenzie-Stuart, Alexandre-Charles Kiss, Dame Rosalyn Higgins, Peter Sand, Ian Brownlie, Christopher Greenwood, Marti Koskenniemi, and Ralph Zacklin. The lectures reflect some of the most significant international concerns of the last two decades. The subjects they address include new trends in international law, international courts and politics, the practitioner's view of international law, international law and revolution, the European Convention of Human Rights, European Community law concepts, the global environment and international law, the current role of the United Nations, international environmental trust funds, international boundary law, international law and imperialism, and humanitarian intervention. This important collection of essays by some of the leading international law figures of our generation will be of equal value to all interested in international law, whether the academic or the practitioner.

Available in PDF, EPUB and Kindle. Book excerpt: The Globalization of International Society re-examines the development of today's society of sovereign states, drawing on a wealth of new scholarship to challenge the landmark account presented in Bull and Watson's classic work, The Expansion of International Society (OUP, 1984). For Bull and Watson, international society originated in Europe, and expanded as successive waves of new states were integrated into a rule-governed order. International society, on their view, was thus a European cultural artefact - a claim that is at odds with recent scholarship in history, politics, and related fields of research. Bringing together leading scholars from Asia, Australia, Europe, and the United States, this book provides an alternative account: it draws out the diversity of polities that existed at around c1500; it shows how interacting identities, political orders, and economic forces were intensifying within and across regions; it details the tangled dynamics that helped to globalize the European conception of a pluralist international society, through patterns of warfare and between East and West. The Globalization of International Society examines the institutional contours of contemporary international society, with its unique blend of universal sovereignty and global law, and its forms of hierarchy that coexist with commitments to international human rights. The book explores the multiple forms of contestation that challenge international society today: contests over the limits of sovereignty in relation to cosmopolitan conceptions of responsibility, disputes over global governance, concerns about persistent economic, racial, and gender-based patterns of disadvantage, and lastly the threat to the established order opened up by the disruptive power of digital communications.

Available in PDF, EPUB and Kindle. Book excerpt: From 1819 to 1914, governments in northern North America struggled to deal with crime and criminals migrating across the Canadian-American border. Limited by the power of territorial sovereignty, officials were unable to simply retrieve fugitives and refugees from foreign territory. Borderline Crime examines how law reacted to the challenge of the border in British North America and post-Confederation Canada. For nearly a century, officials ranging from high court judges to local police officers embraced the ethos of transnational enforcement of criminal law. By focusing on common criminals, escaped slaves, and political refugees, Miller reveals a period of legal genesis where both formal and informal legal regimes were established across northern North America and around the world to extradite and abduct fugitives. Miller also reveals how the law remained confused, amorphous, and often ineffectual at confronting the threat of the border to the rule of law. This engrossing history will be of interest to legal, political, and intellectual historians alike.

Available in PDF, EPUB and Kindle. Book excerpt: Challenging the notion that Nikkei individuals before and during World War II were helpless pawns manipulated by forces beyond their control, the diverse essays in this rich collection focus on the theme of resistance within Japanese American and Japanese Canadian communities to twentieth-century political, cultural, and legal discrimination. They illustrate how Nikkei groups were mobilized to fight discrimination through assertive legal challenges, community participation, skillful print publicity, and political and economic organization. Comprised of all-new and original research, this is the first anthology to highlight the contributions and histories of Nikkei within the entire Pacific Northwest, including British Columbia.
