También el Real Decreto 255/2006, de 3 marzo, que Modifica el Reglamento General de Ingreso del Personal al Servicio de la Administración General del Estado y de Provisión de Puestos de Trabajo y Promoción Profesional de los Funcionarios de la Administración General del Estado, aprobado por Real Decreto 364/1995 y Resolución de 4 de diciembre de 2007 de la CECIR. La LO 3/2007, de 22 marzo, de Igualdad efectiva de mujeres y hombres, Ley Orgánica 1/2004, de 28 diciembre 2004 de Medidas de Protección Integral contra la Violencia de Género y LO 14/2003 de reforma de las LO 8/2000 y 4/2000, que Regula los Derechos y Libertades de los Extranjeros en España y su Integración Social. El estudio recoge la Convención de NNUU sobre los derechos de las personas con discapacidad de 13 diciembre 2006, ratificada por Instrumento de 23 noviembre 2007(BOE abril 2008) y su Protocolo Facultativo. Tanto el acceso a la Administración Pública como su provisión, constituyen actos relevantes para los aspirantes en un caso y para los empleados públicos en otro. La defensa de la transparencia administrativa en el acceso, así como la aplicación de los principios de igualdad, mérito, publicidad y capacidad en la segunda, fraguan la solidez de un Estado de Derecho. Pero también, en lo que refiere a la provisión de puestos, confluyen otros intereses loables de la organización pública, como son la buena llevanza del servicio y la potestad de autoorganización que obligan a adoptar medidas que afectan a los empleados. Estas decisiones deberán ejecutarse con sensibilidad para que la eficiencia gestora no se vea afectada.
