The term "extraterritorial" effect/application/obligation in international law refers to acts that are taken by one actor (state) that have some kind of effect within another country's territory, with or without this second country's implicit or explicit agreement. Extraterritoriality within international human rights law, then, concerns actions or omissions by one state that have an effect on the human rights of individuals in another state - with or without this other state's agreement. This effect may be positive or negative in that such actions or omissions by foreign states may contribute positively to the enjoyment of human rights; or alternatively, they may result in a deteriorated human rights situation, and even human rights violations. Book excerpt: When Médecins Sans Frontières (MSF) was founded in 1971, it was founded with both international and associative dimensions. International because it wouldn’t have made sense for MSF France, on its own, to aid threatened populations around the world and associative because civil law in France, especially the 1901 law governing charitable bodies, was perfectly suited to the MSF organisation’s guiding precepts, which are democratic and selfless in nature. Yet, MSF’s development from a small, purely French organisation to an international associative movement was never carefully planned or particularly smooth. MSF’s development was the result of various compromises between the movement’s leaders, with their individual agendas, and the integration of fait accomplis when necessary. The evolving modifications were debated at length to ensure that concerns raised were legitimate and that there was agreement for decisions made. The nature and the validity of MSF’s leadership were regularly challenged, as was the question of how MSF should grow while remaining true to its humanitarian precepts. This case study elaborates the history of the MSF movement from inception in 1971 through 2011, when MSF legitimised an international governance system and architecture. The study is divided in two episodes. Episode One reviews MSF’s first three decades (1971-2000). Episode Two is about the challenges of the early 21st, century, from 2001 to 2011.

In the media or on the street, we might hear that a specific country has a moral duty to defend human rights, that environmentalists have a moral duty to push for global systemic reform, or that the affluent have a moral duty to alleviate poverty. Do such attributions make conceptual sense or are they mere political rhetoric? And what does that imply for the individual members of these groups? Group Duties offers the first comprehensive answer to these questions. Stephanie Collins defends a Tripartite Model of group duties - so-called because it divides groups into three fundamental categories. First, we have combinations - collections of agents that don't have any goals or decision-making procedures in common. These groups cannot bear moral duties. Instead, we should re-cast their purported duties as a series of duties, one held by each agent in the combination. Each duty demands its bearer to 'I-reason': to do the best they can, given whatever they happen to believe the others will do. Second, there are groups whose members share goals but lack decision-making procedures. These are coalitions. Coalitions also cannot bear duties, but their alleged duties should be replaced with members' several duties to 'we-reason': to do one's part in a particular group pattern of actions, on the presumption that others will do likewise. Third and finally, collectives have group-level procedures for making decisions. They can bear duties. Collectives' duties imply duties for collectives' members to use their role in the collective with a view to the collective doing its duty. With the Tripartite Model in-hand, Collins argues that we can target our political demands at the right entities, in the right way, for the right reasons.
