Il réalise une codification de ces techniques pour en permettre une représentation la plus objective et faciliter les échanges marchands. Le brevet assure les deux fonctions de normalisation. La normalisation de l'objet du droit qui porte sur un objet par essence intellectuel. Et la normalisation du risque que celui-ci fait peser sur la communauté des tiers concurrents, lequel est défini par les uns, et assumé par les autres. La deuxième partie s'intéresse plus specialement au Conseil en propriété industrielle, en tant qu'organe de normalisation du droit subjectif. Elle circonscrit le domaine de l'intervention du Conseil en propriété industrielle qui s'enrichit d'une double dimension technique, mais également juridique. Une définition de la fonction sociale du conseil en propriéte industrielle est ensuite avancée : celui-ci réalise, au travers de sa double dimension, l'arpentage des nouvelles propriétés intellectuelles en permettant, d'une part, d'arracher au continuum du domaine public une parcelle réservée au seul titulaire et, d'autre part, d'assurer à tout interessé une connaissance significative des bornes de la propriété ainsi constituée. Ainsi se trouve réalisée la fonction sociale de l'institution de la propriété à qui l'on confie la charge de ces nouvelles valeurs économiques. Une fonction sociale qui préserve tant les intérêts de l'investisseur en recherche développement que ceux du groupe social.
