Available in PDF, EPUB and Kindle. Book excerpt: English insurance came into being almost entirely during the Elizabethan period. However, the Great Fire of 1666 consumed most of London's mercantile document, and therefore little is known about early English insurance. Using new archival material, this study provides the first in-depth analysis of early English insurance. It focuses on a crucial yet little-known text, the London Insurance Code of the early 1580s, and shows how London insurance customs were first imported from Italy, then influenced by the Dutch, and finally shaped in a systematic fashion in that Insurance Code. The London Insurance Code was in turn heavily influenced by coeval continental codes. This deep influence attests the strong links between English and European insurance, and questions the common/civil law divide on the history of commercial law.

Available in PDF, EPUB and Kindle. Book excerpt: Insurance is a legal, an actuarial and a financial product, and it is one out of many risk management strategies. It follows that its history can only be studied in the broader context of the development of such strategies, applying an interdisciplinary approach. The theme of the present volume is maritime risk management. After an overview over the history of insurance, the contributions to the present volume examine different maritime risk management strategies by adopting a variety of methodological approaches. Some contributions focus on normative provisions, others contrast practice with legal scholarship, or focus on the emergence of insurance companies as opposed to individual insurers. Again, other contributions give insights in marine insurance practice in specific cities or analyse insurance practice through the lens of specific insurance litigation. As to the time frame, the different contributions span from antiquity to the nineteenth century.

Available in PDF, EPUB and Kindle. Book excerpt: Athenian power and prosperity in the fourth century B.C. was based largely on commerce. The complex litigation arising from commercial activities was heard in special maritime courts, dikai emporikai, the subject of this monograph. Using both ancient and secondary sources, Edward E. Cohen has pieced together the evolution of these courts and has explored their procedure and jurisdiction. He successfully treats the much-discussed problem of why they were termed "monthly," and makes it clear that "supranationality" was a feature of all Hellenic maritime law. He shows conclusively that their jurisdiction was limited ratione rerum, not ratione personarum, because a legally defined "commercial class" did not exist in Athens at this time. Classicists and lawyers alike will find this a fascinating study. It not only contributes to our understanding of the Athens of Plato, Aristotle, and Demosthenes, but also points out that certain principles of Athenian maritime law are still imbedded in the modern international law of maritime commerce. It is the first research study based on a wealth of recently disclosed private and family files, and deepens and modifies all earlier evaluations. It enlarges on Asser’s achievements as legal practitioner, university don, pioneer of private international law, diplomat and arbitrator, and State Councillor. It discusses his durable impact as founder of international law bodies and institutions. It likewise highlights the impressive Asser family tradition that exemplifies 19th-century Jewish emancipation in Amsterdam, addresses Asser’s youth and student years, his role as family man and the impact of personal drama on his career. Book excerpt: Since its invention in Italy in the fourteenth century, marine insurance has provided merchants with capital protection in times of crisis, thus oiling the gears of trade and commerce. With a focus on customs, laws, and organisational structures, this book reveals the Italian origins of marine insurance, and tracks the spread of underwriting practices and institutions in Europe and America through the early modern era. With contributions from eleven leading researchers from seven countries, the book examines key institutional developments in the history of marine insurance. The authors discuss its invention in Italy, and its evolution from private to corporate structures, assessing the causes and impacts of various state interventions. Amsterdam and Antwerp are analysed as one-time key centres of underwriting, as is the emergence and maturity of marine insurance in London. The book evaluates an experiment in corporate underwriting in Cadiz, and the development of insurance institutions in the United States, before applying the metrics of underwriting to discuss commerce raiding in the Atlantic up to the nineteenth century.

Available in PDF, EPUB and Kindle. Book excerpt: How an antisemitic legend gave voice to widespread fears surrounding the expansion of private credit in Western capitalism The Promise and Peril of Credit takes an incisive look at pivotal episodes in the West’s centuries-long struggle to define the place of private finance in the social and political order. It does so through the lens of a persistent legend about Jews and money that reflected the anxieties surrounding the rise of impersonal credit markets. By the close of the Middle Ages, new and sophisticated credit instruments made it easier for European merchants to move funds across the globe. Bills of exchange were by far the most arcane of these financial innovations. Intangible and written in a cryptic language, they fueled world trade but also lured naive investors into risky businesses. Francesca Trivellato recounts how the invention of these abstruse credit contracts was falsely attributed to Jews, and how this story gave voice to deep-seated fears about the unseen perils of the new paper economy. She locates the legend’s earliest version in a seventeenth-century handbook on maritime law and traces its legacy all the way to the work of the founders of modern social theory—from Marx to Weber and Sombart. Deftly weaving together economic, legal, social, cultural, and intellectual history, Trivellato vividly describes how Christian writers drew on the story to define and redefine what constituted the proper boundaries of credit in a modern world increasingly dominated by finance.

Book excerpt: As Walker has pointed out, "[this book] was long a standard work and contributed to the continued vitality of the Austinian Analytical Jurisprudence in England though he substituted enforcement by a determinate authority for Austin's command of the sovereign as the criterion of a law." Albert Kocourek characterized this work as "the most successful of all jurisprudence books." Holland [1835-1926] taught philosophy at Oxford before he was called to the Bar in 1863. After several years in practice he was appointed Vinerian Reader in English Law and Chichele Professor of International Law and Diplomacy in 1874. An industrious scholar, he published several important treatises and was a founder of the Law Quarterly Review. Walker, Oxford Companion to Law 576.
