Cultural heritage thus defined is protected by various legal regimes, including the law of armed conflicts, UNESCO Conventions and international criminal law. With a view to strengthening international protection, the authors analyze existing regimes and elaborate innovative concepts, such as blue helmets of culture and safe havens for endangered cultural heritage. Finally, the ends of international protection come to the fore, and the authors address possible conflicts between protecting cultural diversity and wishes to strengthen cultural identity.

Ces droits relèvent de deux catégories principales : les droits de participer à la protection du patrimoine culturel de son choix et les droits d’accéder aux patrimoines culturels tant de valeur nationale que régionale et mondiale. Ces droits sont concrétisés spontanément grâce à l’intégration progressive d’objectifs qui tendent à les mettre en œuvre dans les programmes culturels régionaux. Ils sont également concrétisés grâce aux stratégies augmentatives des requérants et à l’interprétation souvent extensive que les juges des droits humains retiennent des droits justiciables dont ils découlent. La reconnaissance des droits au patrimoine culturel et leur concrétisation témoignent d’une prise de conscience qui a évolué dans le temps et qui pourrait s’orienter vers une pleine garantie de ces droits
