Le dynamisme insufflé par l’organisation de cette mobilité s’étend par ailleurs à l’ensemble des droits du patient puisque certaines dispositions sont assez générales pour intéresser la personne soignée dans son État d’affiliation. La reconnaissance de ces droits peut surprendre au premier abord tant ce thème est éloigné des préoccupations initiales des Communautés. L’objectif de cet ouvrage est donc de démontrer la contribution du droit de l’Union à la reconnaissance et à la mise en œuvre des droits du patient. En l’absence de compétence juridique spécifique, ce sont à la fois la voie des droits fondamentaux et celle du marché intérieur qui ont permis la reconnaissance des droits du patient. L’intérêt pour ce domaine est tel qu’il existe désormais un véritable foisonnement normatif, composé tant de sources déclaratoires qu’obligatoires, pouvant affecter l’accessibilité et l’intelligibilité des droits du patient. La mise en œuvre des droits révèle un double niveau de protection : la dimension transfrontalière des soins est particulièrement propice à la réalité des droits consubstantiels à cette situation, tandis que l’organisation est plus nuancée pour ceux sans lien spécifique avec la mobilité. Ce constat amène notamment à s’interroger sur l’amélioration de l’effectivité des droits. L’ensemble de cette analyse conduit in fine à une réflexion sur l’existence d’un statut juridique du patient, aboutissant à des propositions destinées à renforcer encore la place du patient en droit de l’Union et, par conséquent, le respect de ses droits. Cet ouvrage se destine à un public universitaire spécialisé en droit de la santé, mais également aux juristes (magistrats, avocats...), aux professionnels de la santé ainsi qu’à toute personne intéressée par les interactions entre le droit de la santé et le droit européen au sens large.

Elle s'efforce de tracer les contours de ce droit à partir des définitions apportées par les économistes de la santé, suggérant ainsi que le droit s'amorce et s'enrobe autour de ces particules fondamentales économiques propres aux dispositifs médicaux lato sensu. Depuis la fin de la deuxième guerre mondiale, divers phénomènes sociaux ont favorisé le renouvellement des préoccupations relatives à la santé publique. Le Préambule de la Constitution de l'Organisation Mondiale de la santé de 1946 a donné une définition radicalement nouvelle de la notion de santé, comme un état de complet bien-être physique, mental et social ne consistant pas seulement en une absence de maladie ou d'infirmité. Autrement dit, cette définition porte en elle l'idée d'un état de santé universel et fait de la santé publique à la fois un droit, un bien, et une valeur. La santé publique est à la fois l'affaire de tous et de chacun parce que sans avoir de prix elle a un coût. L'adoption récente de la Charte européenne des droits fondamentaux par les Etats membres de l'Union européenne, illustre l'importance croissante de ce domaine encore peu étudié par les juristes. Le droit européen de la santé publique acquiert peu à peu une effectivité particulière : le droit européen de la santé publique est un droit dérogatoire. Il emprunte les moyens du droit public, les contraintes du droit pénal et les techniques du droit économique pour assurer le maintien de l'ordre public sanitaire. Le processus d'élaboration de la norme constitutionnelle dont l'objet est la protection de la santé publique par les droits constitutionnels nationaux est engagé par chaque Etat membre mais aussi en droit communautaire et européen. Les politiques de santé européenne et nationales laissent peut-être apparaître en filigrane, une certaine architecture nécessaire à l'émergence dans l'espace européen d'un droit protecteur de la santé publique.

Il se trouve qu'en dépit de bases juridiques incertaines, la Communauté s'est intéressée de près aux questions de santé publique et que l'intervention du droit communautaire matériel dans une matière éloignée des préoccupations originelles de la Communauté contribue à l'amélioration de la protection de la santé des citoyens européens, certains Etats n'ayant pas encore de législation en la matière. La protection de la santé publique relevant néanmoins toujours, par principe, de la compétence des Etats membres, l'objectif national de protection de la santé publique se trouve dans le même temps affecté du fait de la communautarisation. Cette dernière ne faisant toutefois pas obstacle à ce que des entités faisant parties d'un système intégré et basé sur la libre circulation des marchandises adoptent des contraintes de santé publique dès lors que ces dernières sont proportionnées, elle contribue à l'amélioration de la protection de la santé des citoyens des Etats qui souhaitent aller plus avant dans la protection de la santé de leurs ressortissants
