Parmi les épreuves du CRFPA, le droit de l'Union européenne est choisi par un nombre croissant de candidats. Il en va de même pour certains concours administratifs (ENA notamment). Pour préparer les examens universitaires, les concours, ou encore les travaux dirigés, il est exigé une connaissance approfondie de la matière, qui peut s'acquérir par la consultation de manuels aujourd'hui nombreux sur le marché. Il faut aussi maîtriser les exercices qui sont demandés au titre du contrôle de connaissances ou des travaux dirigés, dans leur diversité : dissertation, commentaire d'arrêts ou de textes, note de synthèses, cas pratiques. C'est ici que se positionne le présent ouvrage. Il propose en premier lieu un ensemble de conseils pour chaque type d'exercice. Il donne en second lieu une quarantaine d'exemples de corrigés-types sur des sujets couvrant l'ensemble du droit de l'Union européenne, droit institutionnel, contentieux, concurrence et marché intérieur. Les thèmes retenus, pour certains, collent à l'actualité car fréquemment cette dernière inspire les contrôles de connaissances. D'autres reprennent des données "classiques", car il n'est pas rare que l'étudiant soit invité à l'examen ou en travaux dirigés à revenir sur des arrêts ou des pistes de réflexion générale auxquels c'est à lui de donner une actualité. L'ouvrage ne prétend pas à l'exhaustivité en termes de transmission de la connaissance européenne. Au contraire, il s'inscrit plutôt dans l'idée de diffuser les bonnes "recettes", pour ne pas rater une épreuve de droit de l'Union européenne alors qu'on a toutes les connaissances nécessaires pour la réussir. Il s'agit d'un ouvrage d'exercices. Il doit être utilisé dans cette perspective. Après consultation des conseils de méthode, l'utilisateur est invité à un entraînement. A cette fin, il doit consulter le sujet et le traiter en temps réel, puis confronter le résultat auquel il parvient à la correction et aux conseils qui lui sont proposés. Ce travail a été accompli par l'équipe du Centre de Recherche et de Documentation européennes et internationales de l'Université Montesquieu-Bordeaux 4 (CRDEI - EA 4193). Le projeta ainsi réuni ceux qui dans cette université font vivre le droit de l'Union européenne : Professeurs, Maîtres de conférences, Doctorants contractuels, ATER et autres enseignants et chercheurs spécialistes de la matière.

Book excerpt: As of 1st of June 2023, after years of negotiations, setbacks and postponements, the Unitary Patent Package (UPP) enters into force: the European patent with unitary effect (EPUE) becomes a reality and the Unified Patent Court (UPC) starts its activities.Regrettably, the patent regime put in place is not a genuine EU system. Adopted through an enhanced cooperation procedure, it firstly does not include all EU Member States. Secondly, the conditions and the procedure for granting EPUE is in the hands of the European Patent Office, an international organization to which EU is not a party. Lastly, the substantive provisions and the litigation proceedings are defined by an international treaty (the UPC Agreement) to which EU is not a member, and by national laws for the remaining aspects. Such system carves patent law out of the EU legal and judicial orders and reduces the roles of the EU Parliament and Court of Justice. Challenges are numerous in terms of complexity, harmonization objectives, legality, business advantages and wider societal, economic and legal concerns, to name a few.With twenty-eight contributions from academics and practitioners, this book starts with putting the new system into historical, comparative and institutional contexts (Part I) before highlighting some issues under EU law and the perspective of EU integration (Part II).
