Cet ouvrage prend appui sur la lente émergence de structures administratives adossées à des politiques publiques d'accessibilité à la culture pour découvrir un droit de la culture. Constitue-t-il pour autant une branche autonome du droit ? Des textes spécifiques liés aux activités artistiques, muséales, archéologiques, ethnologiques et bien d'autres encore qui permettent de rendre accessibles au public «les oeuvres de l'humanité», dans un souci de conservation et de mise en valeur, constituent l'ossature de ce droit de la culture. Cet ouvrage qui s'adresse aux étudiants des facultés de droit (Master 1 et 2 en droit) mais également aux étudiants des écoles de commerce (Master de gestion) permet de restituer les cadres administratifs du droit de la culture. Pénétré par des modes de gestion privée, le droit de la culture n'est plus seulement «hérité», il est désormais «revendiqué» notamment par des associations qui, dans le cadre d'une action collective, défendent ces nouveaux droits. Dans cette perspective, le droit de la culture est devenu hybride : il faut recomposer l'action publique de la culture dans le cadre de partenariats publics/privés. Après avoir présenté les institutions culturelles et leur agencement, nos propos analysent le rôle des personnes privées dans la prise en charge de ces actions culturelles. Les instruments juridiques à leur disposition permettent de mieux saisir ce «nouveau» droit de la culture.
