It contributes to the topical academic debate on ‘family law exceptionalism’ by exploring the blurred lines between public law, private law and family law, and sheds light on the many shades of grey that exist. The contributions focus on both substantive and procedural family law on parents and children and on life partners, with particular attention for contractual arrangements of family formations and of conflict resolution. The hypothesis underlying all contributions was the trend towards contractualisation of family law. A convergent research outcome resulting from the comparison of national reports was the ambivalent position of family law in legal systems worldwide. That comparison shows that, whereas family law is clearly moving towards contract with regard to old family formations, the contrary is true for new family formations. The movement towards contract is rarely considered to be contractualisation pur sang, with civil effect. The movement towards status, finally, does not necessarily witness ‘family law exceptionalism’ vis-à-vis private law, in view of the increasing State interventionism in private law relations in general. In sum, as the volume shows, the high permeability of the demarcations between the State, the family and the market impedes a categorial approach. This volume is based on the general and selected national reports on the topic “Contractualisation of Family Law” that were presented at the XIXth International Congress of Comparative Law in Vienna in July 2014.

Book excerpt: Since the 1980s, neoliberals have openly contested the idea that the state should protect the socio-economic well-being of its citizens, making ‘privatization’ their mantra. Yet, as historians and social scientists have shown, welfare has always been a ‘mixed economy’, wherein private and public actors dynamically interacted, collaborating or competing with each other in the provision of welfare services. This book will be of interest to students, scholars and practitioners of welfare by developing three innovative approaches. Firstly, it illuminates the productive nature of public/private entanglements. Far from amounting to a zero-sum game, the interactions between the two sectors have changed over time what welfare encompasses, its contents and targets, often engendering the creation of new fields of intervention. Secondly, this book departs from a well-established tradition of comparison between Western nation-states by using and mixing various scales of analysis (local, national, international and global) and by covering case studies from Spain to Poland and France to Greece in the nineteenth and twentieth centuries. Thirdly, this book goes beyond state centrism in welfare studies by bringing back a host of public and private actors, from municipalities to international organizations, from older charities to modern NGOs. This monograph considers the codification project in light of a series of broader analytical frameworks – comparative, historical and constitutional – which make modern codification phenomena intelligible. This new reading across fields renders the European codification project (currently being promoted through the Common Frame of Reference and the Optional Sales Law Code proposal) vulnerable to constitutionally-grounded criticism, traceable to normative considerations of private law authority and legitimacy. Arguing that modern codification phenomena are more complex than positivist, socio-legal and historical approaches have suggested over the past two centuries, the book stages a pathbreaking method of analysis of the law-discourse (nomos-centred) which questions at once the reduction of private law to legislation and of law to power and, on this basis, redefines the ways in which to counter law's disintegration and crisis in the context of Europeanisation. Professor Niglia reconstructs the European codification project as a complex structure of government-in-the-making that embodies a set of contingent world views, excludes alternatives, challenges the plurality of private laws and entrenches conflicts that pertain not only to form (codification, de-codification, recodification) but also to dilemmas implicated in determining the substantive orientation of European private law.
