Book Synopsis Alcohol, Drugs, and Impaired Driving by : A. Wayne Jones
Download or read book Alcohol, Drugs, and Impaired Driving written by A. Wayne Jones and published by CRC Press. This book was released on 2020-06-15 with total page 564 pages. Available in PDF, EPUB and Kindle. Book excerpt: Alcohol, Drugs, and Impaired Driving addresses many theoretical and practical issues related to the role played by alcohol and other psychoactive drugs on driving performance, road-traffic safety, and public health. Several key forensic issues are involved in the enforcement of laws regulating driving under the influence of alcohol and/or other drugs, including analytical toxicology, pharmacology of drug action, as well as the relationships between dose taken, concentration levels in the body, and impairment of performance and behavior. Our knowledge of drunken driving is much more comprehensive than drugged driving, so a large part of this book is devoted to alcohol impairment, as well as impairment caused by use of drugs other than alcohol. For convenience, the book is divided into four main sections. The first section gives some historical background about measuring alcohol in blood and breath as evidence for the prosecution of traffic offenders. The important role of the Breathalyzer instrument in traffic-law enforcement, especially in Australia, Canada, and the USA is presented along with a biographical sketch of its inventor (Professor Robert F. Borkenstein of Indiana University) with focus on the man, his work and his impact. The second section discusses several issues related to forensic blood and breath-alcohol alcohol analysis as evidence for prosecution of traffic offenders. This includes how the results should be interpreted in relation to impairment and an evaluation of common defense challenges. Because most countries have adopted concentration per se laws, the main thrust of the prosecution case is the suspect’s measured blood- or breath-alcohol concentration. This legal framework necessitates that the analytical methods used are "fit for purpose" and are subjected to rigorous quality assurance procedures. The third section gives a broad overview of the current state of knowledge about driving under the influence of non-alcohol drugs in various countries. This includes adoption of zero-tolerance laws, concentration per se statutes, and clinical evidence of driver impairment based on field sobriety tests and drug recognition expert evidence. The fourth section deals with epidemiology, enforcement, and countermeasures aimed at reducing the threat of drunken and drugged driving. All articles have appeared previously in the international journal Forensic Science Review, but all are completely updated with current data, references, and the latest research on developments since the articles were published. This book contains a convenient collection of the best articles covering recommendations for blood and breath testing methods, public policy relating to such methods, and forensic and legal implications of the enforcement of measures to counter driving under the influence.
Book Synopsis How to Win Your Drunk Driving Case by : David A. Haggett
Download or read book How to Win Your Drunk Driving Case written by David A. Haggett and published by CreateSpace. This book was released on 2011-08-01 with total page 78 pages. Available in PDF, EPUB and Kindle. Book excerpt: If you or a family member has been cited for drunk driving it is not a charge to take lightly. This is a serious matter that needs to be taken seriously. Your job, money, driving privileges, traveling, and freedom are all at stake. Every year in the US over One Million people are charged with operating a motor vehicle under the influence of alcohol or drugs. No matter where you live, a driving under the influence (DUI) conviction is a very serious matter. Even first-time offenders are looking at time in jail and probation as well as a driver's license suspension. Drunk-driving is one of the most commonly committed crimes in the Unites States. As a matter of fact, 41 percent of all vehicle accidents involve alcohol and/or drugs, and 3 out of 10 people will face a drunk-driving situation during their lifetime. Drunk driving is referred to as driving under the influence (DUI) or driving while intoxicated (DWI), depending on the state in which the crime is committed. Each state is responsible for creating its own drunk-driving laws. In every state, it is against the law for people over the age of 21 to drive a motor vehicle with a blood alcohol content (BAC) of 0.08 percent or higher. Due to zero tolerance laws, minors under the age of 21 may not drive with any alcohol in their system, even if they are not impaired by alcohol. We show you how to beat the charge and better yet- How to avoid getting charged at all These secrets are known to a very select few law enforcement personnel and are never shared with the general public. Most lawyers have never even heard of these tactics because they are used behind the scenes and are never revealed in open court. DUI convictions are actually comprised of two parts The administrative license suspension and the criminal court case. The administrative part of a DUI arrest is a civil proceeding and deals with your license and driving record. The criminal case deals with penalties, fines, and sentencing Your criminal proceedings begin soon after your DUI arrest. You will be asked to appear at the arraignment, where you will enter a plea. After this comes the trial and sentencing (if convicted). The sentence for DUI may include fines, jail time, probation, community service, and mandatory alcohol counseling or treatment. In certain circumstances, you may be required to install an ignition interlock device in your vehicle. There are several factors in a DUI case that may lead to harsher punishments, such as having prior DUI convictions on your record. Driving with an excessively high BAC or refusing to take a chemical test also leads to more severe sentencing. In addition to the criminal penalties, you face consequences in your personal life. Your DUI conviction will remain on your record, and may be a deterrent to future employers. You will also have to purchase high-risk auto insurance in able to drive.
