Book excerpt: The Act is primarily intended to implement key aspects of the Government's Rural Strategy and addresses issues relating to the natural environment. The Act establishes an independent body - Natural England - responsible for conserving, enhancing and managing England's natural environment for the benefit of current and future generations. Natural England brings together the functions of English Nature and certain functions currently performed by the Countryside Agency and the Rural Development Service (a Defra Directorate). The Act also establishes the Commission for Rural Communities ("the Commission"). The Commission will be an independent advocate, watchdog and expert adviser for rural England, with a particular focus on people suffering from social disadvantage and areas suffering from economic under-performance. The Act also reconstitutes the Joint Nature Conservation Committee and renames and reconstitutes the Inland Waterways Amenity Advisory Council (which becomes the Inland Waterways Advisory Council). The Act makes provision in respect of biodiversity, pesticides harmful to wildlife and the protection of birds, and in respect of invasive non-native species. It alters enforcement powers in connection with wildlife protection, and extends time limits for prosecuting certain wildlife offences. It addresses a small number of gaps and uncertainties in relation to the law on sites of special scientific interest. And it amends the functions and constitution of National Park authorities, the functions of the Broads Authority and the law on rights of way.

Book excerpt: This report examines the draft Climate Change Bill, which published in March 2007 as Command paper Cm 7040 (ISBN 9780101704021). Target setting alone cannot deliver policy objectives, but enshrining one in law will strengthen the Government's resolve to achieve it, ensure greater public accountability, and give confidence to the business community whose investment decisions are central to meeting the target. The Committee recommends a number of changes to the bill. Inconsistency in language, with "UK carbon account" and "UK carbon dioxide emissions" seemingly used interchangeably, should be addressed. There should not be an upper limit on the 2020 target (26-32 per cent reduction in carbon dioxide emission), and the Bill should make provision for both the 2020 and 2050 targets to be revised, though only in an upwards direction. The provision to amend a budget more than a year after the end of a budgetary period is seen as making a nonsense of the concept of budgetary periods, and should be removed completely. The proposed Committee on Climate Change, rightly composed of experts, should not appear to give more representation to economic interests over environmental ones. The resources proposed for the Committee may prove inadequate. The Committee recommends that the impact of climate change on biodiversity should be added to the Bill.

Book excerpt: Wildlife legislation has become so complex that prosecutions fail and even specialist enforcement professionals struggle to implement it effectively. Hundreds of birds of prey have been deliberately poisoned with substances such as carbofuran that have no legal use and the Government could easily make possession an offence. The lack of sentencing guidelines on wildlife offences means that some offenders are being neither punished nor deterred in the courts. The CPS is also failing to train its prosecutors to handle complex wildlife cases. Furthermore, the inflexible implementation in UK law of international agreements covering the trafficking of endangered species squanders limited resources. The Government has maintained funding for specialist wildlife crime investigation and enforcement, but this is provided on an ad hoc basis, reducing operational effectiveness. Funding provided to monitor wildlife crime on the internet was too short-term to attract a suitably qualified individual to fill the post. In 2004, the Committee called for a new database to record all wildlife crime but this has still not been introduced. Internationally, this report also examines how the rhino, tiger and elephant are being driven to extinction by growing demand for illegal wildlife products in south-east Asia and China. The Government needs to exert robust diplomatic pressure in favour of the development and enforcement of wildlife law at the next CITES meeting in March 2013. In particular, the Government should focus attention on the damaging effect of 'one-off' sales of impounded ivory, which has been found to actually fuel demand for ivory products, and seek an unequivocal international ban on all forms of ivory trade.
