Available in PDF, EPUB and Kindle. Book excerpt: Published in concomitance with the adoption of the United Nations Declaration on the Rights of Indigenous Peoples, this volume brings together a group of renowned legal experts and activists from different parts of the world who, from international and comparative perspectives, investigate the right of indigenous peoples to reparation for breaches of their individual and collective rights. The first part of the book is devoted to general aspects of this important matter, providing a comprehensive assessment of the relevant international legal framework and including overviews of the topic of reparations for human rights violations, the status of indigenous peoples in international law, and the vision of reparations as conceived by the communities concerned. The second part embraces a comprehensive investigation of the relevant practice at the international, regional, and national level, examining the best practices of reparations according to the ideologies and expectations of indigenous peoples and offering a comparative perspective on the ways in which the right of these peoples to redress for the injuries suffered is realized worldwide. The global picture painted by these contributions provides a view of the status of relevant international law that is synthesized in the two final chapters of the book, which include a concrete example of how a judicial claim for reparation is to be structured and prescribes the best practices and strategies to be adopted in order to maximize the opportunities for indigenous peoples to obtain effective redress. As a whole, this volume offers a comprehensive vision of its subject matter in international and comparative law, with a practical approach aimed at supporting legal academics, administrators, and practitioners in improving the avenues and modalities of reparations for indigenous peoples.

Available in PDF, EPUB and Kindle. Book excerpt: "Building on the success of the first two editions, this volume briefly recaps the historical development and public acceptance of the concept of Aboriginal self-government, then proceeds to examine its theoretical underpinnings, the state of Aboriginal self-government in Canada today, and the many practical issues surrounding implementation. Topics addressed include: justice innovations, initiatives in health and education to grant greater Aboriginal control, financing and intergovernmental relations, Aboriginal-municipal government relations, developing effective Aboriginal leadership, Métis self government aspirations, the intersection of women's rights and self-government, and international perspectives. Various self-government arrangements already in existence are examined including the establishment of Nunavut, the James Bay Agreement, Treaty Land Entitlement settlements, the Alberta Métis settlements, and many other land claims settlements that have granted Aboriginal communities greater control over their affairs."--Pub. website.

Available in PDF, EPUB and Kindle. Book excerpt: Part ethnography, part narrative, Like the Sound of a Drum is evocative, confrontational, and poetic. For many years, Peter Kulchyski has travelled to the north, where he has sat in on community meetings, interviewed elders and Aboriginal politicians, and participated in daily life. In Like the Sound of a Drum he looks as three northern communities -- Fort Simpson and Fort Good Hope in Denendeh and Pangnirtung in Nunavut -- and their strategies for maintaining their political and cultural independence. In the face of overwhelming odds, communities such as these have shown remarkable resources for creative resistance. In the process, they are changing the concept of democracy as it is practised in Canada.

This book was released on 2000 with total page 428 pages. Available in PDF, EPUB and Kindle. Book excerpt: Canada: State of the Federation, 1999–2000 identifies and explains major threads in Canadian fiscal federalism. Set against the cacophony over domineering and arrogant centralization from supporters of Quebec sovereignty/session on the one hand, and fears that excessive decentralization is fuelling an obsessively neo-liberal agenda on the other, these essays replace much of this heat with new light. The authors begin with an examination of recent developments in the theoretical literature surrounding fiscal federalism. They then examine some of the major issues facing the federation – Is there a vertical imbalance between federal and provincial governments? Does Ottawa collect more revenues than are needed relative to its spending responsibilities while the provinces are under-funded? How do federal-provincial struggles over money and jurisdictional power affect local government or the para-public sector, emerging aboriginal governments, and citizens? Federal government actions in 1999 suggest that Ottawa has not lost all of its interest in social outcomes. It is, however, seeking to influence the well-being of citizens by transferring money to them directly rather than through transfers to provinces. The authors suggest that if this trend continues the approach to the millennium will be seen as a watershed in public policy, given that current trends in Canadian fiscal federalism are as much about re-balancing the federation as they are about decentralization.
