Book excerpt: As the first exporter of cultural goods and services, the United States has long held that such products should be treated like any other merchandise and be liberalized. On the other hand, for countries such as France and Canada who are concerned about the impact of economic globalization and the digital revolution on their cultural identity, cultural products should be exempted from economic liberalization or subject to a cultural exception. conflicting views and interests between states as to the treatment of cultural products in international economic law lie at the hearth of the trade and culture debate. These differences have led to serious tensions over the liberalization of cultural services within the World Trade Organization, as well as to a Convention within UNESCO to recognize the economic and cultural character of cultural products and the states’ right to pursue cultural policies. With most states still not keen on liberalizing the cultural sector and the stalemate in the Doha Round, the United States has turned to preferential trade agreements to secure its policy preferences on the treatment of cultural products. Since the beginning of the twenty-first century, the US government has concluded eleven trade agreements grouping sixteen countries and has been involved in three sets of plurilateral negotiations, with major implications for the evolution of the trade and culture debate.

While this move is endorsed by International Law, it is not the case for globalization; for their own sake, proponents of globalization should recognize that the states are irreplaceable as long as they remain the sole providers of protection for their peoples.

Book excerpt: In Exception Taken, Jonathan Buchsbaum examines the movements that have emerged in opposition to the homogenizing force of Hollywood in global filmmaking. While European cinema was entering a steady decline in the 1980s, France sought to strengthen support for its film industry under the new Mitterrand government. Over the following decades, the country lobbied partners in the European Economic Community to design strategies to protect the audiovisual industries and to resist cultural free-trade pressures in international trade agreements. These struggles to preserve the autonomy of national artistic prerogatives emboldened many countries to question the benefits of accelerated globalization. Led by the energetic minister of culture Jack Lang, France initiated a series of measures to support all sectors of the film industry. Lang introduced laws mandating that state and private television invest in the film industry, effectively replacing the revenue lost from a shrinking theatrical audience for French films. With the formation of the European Union in 1992, Europe passed a new treaty (Maastricht) that extended its legal purview to culture for the first time, setting up the dramatic confrontation over the General Agreement on Trade and Tariffs (GATT) in 1993. Pushed by France, the EU fought the United States over the idea that countries should preserve their right to regulate cultural activity as they saw fit. France and Canada then initiated a campaign to protect cultural diversity within UNESCO that led to the passage of the Convention on Cultural Diversity in 2005. As France pursued these efforts to protect cultural diversity beyond its borders, it also articulated "a certain idea of cinema" that did not simply defend a narrow vision of national cinema. France promoted both commercial cinema and art cinema, disproving announcements of the death of cinema.

This book provides an in-depth account of how two second-tier languages, Japanese and German, are affected by this process. The desirability of a single all-purpose language for all communication needs is seldom questioned. Organised into three themes, ‘Movement and Identity in the Transmanche Zone’; ‘Travel and exchange’; ‘Identity and Landscape’, the papers seek to articulate notions of frontier, mobility and identity from the end of the 3rd to the beginning of the 1st millennium BC, a time when the archaeological evidence suggests that the sea facilitated connections between peoples on both sides of the Channel rather than acting as a barrier as it is so often perceived today. Recent decades have since a massive increase in large-scale excavation programmes on either side of the Channel in advance of major infra-structure and urban development, resulting in the acqusition of huge, complex new datasets enabling new insights into later prehistoric life in this crucially important region. Papers consider the role of several key archaeologists in transforming our appreciation of the connectivity of the sea in prehistory; consider the extent to which the Channel zone developed into a closely unified cultural zone during later Bronze Age in terms of communities that serviced the movement of artefacts across the Channel with both sides sharing widely in the same artefacts and social practices; examine funerary practices and settlement evidence and consider the relationship between communities in social, cultural and ideological terms; and consider mechanisms for the transmission of ideas and how they may be reflected in the archaeological record. In addition to the increasing marginalization experienced by its English speaking component in many domains (politics, administration, economy, culture), it is facing mounting inequality and disarray despite the nation-building aspirations at reunification in 1961. This book examines the very basis of the union crisis by tracing the causes to the asymmetrical nature of negotiations between the contracting partners the founding fathers of the union and the politics of guile and force that has characterized the regimes in Yaound. From a federal model that takes the equality of the contracting parties as a given, the polity has developed into an ethno-regional patchwork designed by its architects to be essentially unequal in nature. Consequently, the segmented Anglophone community can exist only in contradiction within itself. They have been worked into the regimes statecraft of consciously maintaining or re-activating ethnic boundaries inherited from colonialism. An analysis of the cultural and linguistic dimension of the union shows contrasting drives between the assimilation/attempts to dominate by the French-speaking component and resistance by Anglophones. The analyses further show the projected harmonization and rollback by the State, the creative blends and the crystallization around continuing or reproduced colonial experiences, a fierce competition between elites with a drive to impose the culture of the demographically dominant and a refusal to accept the idea of a linguistic minority. The contentious experience, Yenshu Vubo argues, can still be remedied by reforms in a politics of possibilities.These reforms must be ready to re-examine the constitutional basis of the union by revisiting the often dismissed question of the form of the state defined as one and indivisible (a new federal architecture as requested by several political voices). Institutions should be restructured to attend to diversity issues and essential linguistic differences while consolidating any strategic gains of the union such as the creative blends and the acceptance of specifi cities of each community, statutory equality of citizenship and the essential clauses of the fi rst federation.
