Book Synopsis Disease and the Compensation Debate by : Jane Stapleton
Download or read book Disease and the Compensation Debate written by Jane Stapleton and published by Oxford University Press on Demand. This book was released on 1986 with total page 190 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book looks anew at the tort remedy and reform proposals surrounding the modern debate on compensation for personal injuries. Arguing that serious distortions underlie the debate because of its focus on victims of traumatic accidents, the author calls for the consideration of other legally neglected but highly publicized sources of disability including man-made health hazards such as asbestos, tobacco, and Agent Orange, and socially-spread diseases such as AIDS. This ground-breaking study demonstrates that attention to such crucial issues explodes much of the conventional wisdom about just how to tackle reform and reveals that a fundamental rethinking of the compensation debate is urgently needed.

Book Synopsis Torts on Three Continents by : Kylie Burns
Download or read book Torts on Three Continents written by Kylie Burns and published by Oxford University Press. This book was released on 2024-08-06 with total page 417 pages. Available in PDF, EPUB and Kindle. Book excerpt: Professor Jane Stapleton is one of the world's leading experts on causation and has had a profound impact on tort law scholarship, both in terms of the incredible range of topics she has contributed to, and across the multiple countries she has worked in. Torts on Three Continents: Honouring Jane Stapleton brings together a group of scholars from Stapleton's 'home' country Australia, from the United Kingdom, where she spent much of her professional career, and the United States, where she has made such a significant contribution, to celebrate and honour her work. Torts on Three Continents reveals the impressive and enviable breadth of Jane Stapleton's scholarship while contributing to many of the ongoing and traditional debates in tort. The volume is split into four parts. The first part focuses on general themes that arise in Stapleton's work, including the academic influence on judges, the role of insurance in compensation, the impact of vulnerability on tort law and liability of public authorities. The second part considers aspects of liability in the tort of negligence, including duties of care for psychiatric harm. The third part is dedicated completely to causation, with three chapters from authors in three different countries reflecting on the impact of Stapleton's work in this area. The final section covers a variety of different aspects of tort law and compensation systems, including harms committed in the public interest, damage in economic torts, statutory product liability reforms and alternative compensation scheme design. Powerful and thought-provoking, this book will provide its readers with an appreciation of the magnitude of Jane Stapleton's contribution across the common law world, and a novel perspective on some of the more modern challenges faced in tort law.

This book was released on 1999-03-05 with total page 391 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the mid-1980s public health officials in North America, Europe, Japan, and Australia discovered that almost half of the hemophiliac population, as well as tens of thousands of blood transfusion recipients, had been infected with HIV-tainted blood. This book provides a comparative perspective on the political, legal, and social struggles that emerged in response to the HIV contamination of the industrialized worlds blood supply. It describes how eight nations responded to the first signs that AIDS might be transmitted through blood, and how they falteringly arrived at and finally implemented measures to secure the blood supply. The authors detail the remarkable saga of the mobilization of hemophiliacs who challenged the state, the medical establishment, and even their own caregivers as they sought recompense and justice. In the end, the blood establishments in almost every advanced industrial nation were shaken. In Canada, the Red Cross was forced to withdraw from blood collection and distribution. In Japan, pharmaceutical firms that manufactured clotting factor agreed to massive compensation -- $500,000 per hemophiliac infected. In France, blood officials went to prison. Even in Denmark, where the number of infected hemophiliacs was relatively small, the struggle and litigation surrounding blood has resulted in the most protracted legal and administrative conflict in modern Danish history. Blood Feuds brings together chapters on the experiences of the United States, Japan, France, Canada, Germany, Denmark, Italy, and Australia with four comparative essays that shed light on the cultural, institutional, and economic dimensions of the HIV/blood disaster.

Book Synopsis Tort Law and the Legislature by : TT Arvind
Download or read book Tort Law and the Legislature written by TT Arvind and published by Bloomsbury Publishing. This book was released on 2012-12-21 with total page 546 pages. Available in PDF, EPUB and Kindle. Book excerpt: The study of the law of tort is generally preoccupied by case law, while the fundamental impact of legislation is often overlooked. At a jurisprudential level there is an unspoken view that legislation is generally piecemeal and at best self-contained and specific; at worst dependent on the whim of political views at a particular time. With a different starting point, this volume seeks to test such notions, illustrating, among other things, the widespread and lasting influence of legislation on the shape and principles of the law of tort; the variety of forms of legislation and the complex nature of political and policy concerns that may lie behind their enactment; the sometimes unexpected consequences of statutory reform; and the integration not only of statutory rules but also of legislative policy into the operation of tort law today. The apparently sharp distinction between judicially created private law principles, and democratically enacted legislative rules and policies, is therefore questioned, and it is argued that to describe the principles of the law of tort without referring to statute is potentially highly misleading. This book shows that legislation is important not only because of the way it varies or replaces case law, but because it also deeply influences the intrinsic character of that law, providing some of its most familiar characteristics. The book provides the first extended interpretation of legislative intervention in the law of tort. Each of the chapters, by leading tort scholars, deals with an aspect of the influence of legislation on the law of tort. While the nature, sources and extent of legislative influence in personal injury law is an essential feature of the collection, other significant areas of tort law are explored, including tort in the context of commercial law, labour law, regulation and the welfare state. Essays on the Compensation Act 2006 and Human Rights Act 1998 bring the current state of the interplay between tort, politics and legislation to the forefront. In all of these contexts, contributors explore the deeper lessons that can be learned about the nature of the law of tort and its changing role and functions over time.
