Book excerpt: Equity is a multi-faceted subject, an authentic crossroads of problems. The perspective of this study is, as a result, a mix of focuses, which includes: the philosophy of law, general legal theory, justice theory, the history of law, comparative law, legal dogma, etc. In this book, as in various earlier studies of the author, she uses the "three-dimensional" method, which facilitates a stratified focus in agreement with three levels: facts, norms, and values. The subject of equity has never been analysed as completely as in this work. It includes a dynamic study of the different types of equity throughout history and in the different legal systems; the concept, content, limits, functions and types of equity; the relationship between equity and related ideas, and equity in all the branches of the legal order.

Available in PDF, EPUB and Kindle. Book excerpt: What this book intends to do is to study three-dimensionalism (the distinction values-norms-facts) not in what could be called its historical dimension, but in its substantive aspect, as a “form” that, when applied to different legal themes, would add a “material content” to the three-dimensional theory. We can point out, as a study plan, the distinction between “three” perspectives: Those of the legal norm, of the legal order, and the legal relationship. Three-dimensionalism also appears in this work when one analyzes the “three” phases of the life of the law: The formation, the interpretation, and the application; and in the distinction between the “three” characteristics of the legal order: Fullness, coherence, and unity—the theory of legal validity, intended as legitimacy, as validity strictly speaking, or as effectiveness.

Available in PDF, EPUB and Kindle. Book excerpt: Globalisation, religion and development have sparked much interest and debates in the last two decades. The analysis of religion and especially Islam has been presented in a simplistic notion of linear development, and the supposed inability to adapt to modernity and capitalism. This journal will consider such views and assess their validity by focusing on: Part 1: introducing the theoretical issues and debates surrounding globalisation, religion and development, illustrating the often-contested nature of the concepts, and considering the implications for modernity and development. Part 2: continuing with the same theme but focusing on gender and development, representation of women, the effect of modernisation on the increasing consumption of alcohol in Kazakhstan, women's access to higher education in revolutionary Iran and finally women and domestic violence. Part 3: focusing on case studies to explore the implications of globalisation, regionalisation and development in Iran, Turkey, Sudan, Peru and Senegal.

Available in PDF, EPUB and Kindle. Book excerpt: What did it mean to be a woman in colonial Spanish America? Given the many advances in women's rights since the nineteenth century, we might assume that colonial women had few rights and were fully subordinated to male authority in the family and in society—but we'd be wrong. In this provocative study, Kimberly Gauderman undermines the long-accepted patriarchal model of colonial society by uncovering the active participation of indigenous, mestiza, and Spanish women of all social classes in many aspects of civil life in seventeenth-century Quito. Gauderman draws on records of criminal and civil proceedings, notarial records, and city council records to reveal women's use of legal and extra-legal means to achieve personal and economic goals; their often successful attempts to confront men's physical violence, adultery, lack of financial support, and broken promises of marriage; women's control over property; and their participation in the local, interregional, and international economies. This research clearly demonstrates that authority in colonial society was less hierarchical and more decentralized than the patriarchal model suggests, which gave women substantial control over economic and social resources.
