Un’impunità diffusa, agevolata dalle complicazioni processuali e frustrante per il cittadino onesto e osservante. Una formazione professionale difettosa, affidata a università che restituiscono alla società dei tecnici, ma non dei giuristi in grado di percepire i contesti socio-politici da cui le regole scaturiscono e a cui sono destinate. Una magistratura costituzionalmente disegnata più come centro di potere che come potere di servizio, con un tasso di entratura in organi di garanzia eccessivo e sproporzionato. Un’avvocatura a cui la Costituzione ha assegnato la funzione della difesa processuale, ma che non per questo può ritenersi autorizzata ad agire per sviare la retta applicazione della legge. Privati cittadini che usualmente dichiarano il falso per ottenere benefici economici. Così il diritto si fa strumento di alterazione di tutto un contesto storico: può giungere a negare se stesso, divenendo uno strumento di legittimazione di menzogne istituzionali. Ma solo buoni ordinamenti normativi potranno restituirci buone società. Perciò è necessario che si generi, a partire dalle facoltà giuridiche, una robusta opera di riacculturamento. C’è bisogno di operatori più dotti e più eticamente corredati, meno tecnici e meno formalisti: il diritto non può essere un attrezzo per i giochi del potere o una specie di scommessa sul futuro, ma è una promessa istituzionale che va presa sul serio da tutti.
