Di conseguenza per rispondere a queste domande spesso non basterà solo la memoria, ma sarà necessario anche il ragionamento.Le risposte, d'altro canto, non sono solo una secca risposta alla domanda, ma costituiscono la spiegazione dell'argomento posto nella domanda, e quindi l'idea è anche quella di far imparare la materia attraverso le risposte che sono fornite da un ipotetico studente preparato e intelligente che ha studiato e compreso gli argomenti.D'altro canto per esperienza comune, in un esame difficilmente in una risposta si riesce a riportare tutto quanto scritto in un testo universitario; al contrario lo stesso esaminatore si aspetta che le risposte siano complete ma sintetiche e senza giri di parole.Per questo motivo le domande e risposte di diritto costituzionale e pubblico costituiscono esse stesse un testo relativo alle materie espresso in maniera sintetica, ma completa, con un linguaggio che simula quello parlato, come accade agli esami.D'altro canto anche per chi deve sostenere un esame scritto a risposta multipla, la conoscenza della materia attraverso questo testo gli permetterà di imparare rapidamente gli argomenti e di allenarsi, comunque a rispondere a delle domande. In questi casi infatti, è praticamente inutile allenarsi con test e mandarli a memoria. A parte che si tratta di un lavoro alienante, anche ammesso che si riesca a mandare tutte le domande e risposte a memoria, nulla assicura che nei test preparati per il concorso vi siano proprio quelle domande.Solo la conoscenza della materia potrà nella maggior parte dei casi, essere utile per superare simili esami, che vedono, tra l'altro, anche domande trabocchetto e dove comunque è spesso necessario ragionare per scegliere tra le risposte quella giusta.

How did lawlessness become an axiom about Chineseness rather than a fact needing to be verified empirically, and how did the United States assume the mantle of law’s universal appeal? In a series of wide-ranging inquiries, Teemu Ruskola investigates the history of “legal Orientalism”: a set of globally circulating narratives about what law is and who has it. For example, why is China said not to have a history of corporate law, as a way of explaining its “failure” to develop capitalism on its own? Ruskola shows how a European tradition of philosophical prejudices about Chinese law developed into a distinctively American ideology of empire, influential to this day. The first Sino-U.S. treaty in 1844 authorized the extraterritorial application of American law in a putatively lawless China. A kind of legal imperialism, this practice long predated U.S. territorial colonialism after the Spanish-American War in 1898, and found its fullest expression in an American district court’s jurisdiction over the “District of China.” With urgent contemporary implications, legal Orientalism lives on in the enduring damage wrought on the U.S. Constitution by late nineteenth-century anti-Chinese immigration laws, and in the self-Orientalizing reforms of Chinese law today. In the global politics of trade and human rights, legal Orientalism continues to shape modern subjectivities, institutions, and geopolitics in powerful and unacknowledged ways.
