Para o auto, a jurisdição é o espaço próprio do exercício da cidadania constitucional jurisdicional - direito ao serviço gratuito e efetivo, que derivada dos textos fundamentais dos artigos da Constituição Federal em seus artigos 1o, 3o a 5o, em espacial seu inciso LXXIV, que vem sendo negligenciados em sua força normativa constitucional, quando os Tribunais nega-lhes efetividade, traduzida no impedimento infralegal de acesso à justiça e à ordem jurídica justa, aos hipossuficientes e excluídos socialmente, no que isto evidencia que "O Tribunal está fechado para os pobres". Em uma sociedade que tem fome e se de justiça, porque vem historicamente sendo explorada, o exercício dos direitos sociais e individuais, em juízo, é fundamental, superar as desigualdades sociais, erradicar a pobreza, fulcrada em firme hermenêutica constitucional, a ser voltada para a concretização do projeto histórico de construção de uma sociedade livre, justa e solidária. Para tanto, a jurisdição deve ser ciosa da necessária concretização de que, "o Tribunal não pode estar fechado para os pobres", já que exerce o monopólio da jurisdição, fazendo-se serviço à sociedade, sobretudo, para os que tem sede e fome de justiça, possibilitando a todos o uso de todas as forças de direito e de defesa, com paridade de armas, efetivando a cidadania constitucional social, para que se afirme a Justiça como imparcial e legítima. O exercício do monopólio da jurisdição exige o cumprimento de deveres constitucionais e tem como corolário o serviço eficiente e imparcial. O expressa a luta pela efetivação da democracia na cidadania jurisdicional constitucional que é fundada no acesso à justiça e à ordem jurídica justa, que somente é possível, por intermédio de uma hermenêutica constitucional que traduz a principiologia da Constituição de 1988 no projeto histórico, de construção de uma sociedade livre, justa e solidária, fundada na cidadania e dignidade da pessoa humana e do máximo existencial.
