Book excerpt: O direito ao meio ambiente saudável, direito fundamental, positivado nas Constituições e nos tratados internacionais, apresenta características próprias dos chamados direitos de solidariedade (Hans Jonas), nesse aspecto "todos" tem direito a ele. Por outro lado, na decantação de suas características básicas, observa-se, ontologicamente pela noção de ecossistema (autopoiesis de Humberto Maturana), uma maior preocupação com os outros entes componentes do sistema do que a ciência econômica procura valorar ao considerar o meio ambiente como uma arena competitiva (Darwin), um mero fator de produção (homo faber de Arendt). Assim, verificou-se, no passado e na atualidade, a permanente tensão dialética entre o ser humano e os outros seres animados e inanimados que, juntos, formam um todo indissociável interdependente (ecologia integral). À chamada visão antropocêntrica (aquela na qual a Natureza existe sempre como valor instrumental cujo destinatário exclusivo é o homem) contrapõe-se uma visão ecocêntrica, que considera relevantes todas as coisas animadas e inanimadas do meio ambiente, possuindo valor que transcende a utilização instrumental pelo homem. Esta visão de que há outros interesses além dos humanos na proteção do meio ambiente, opõe-se à visão antropocêntrica trazida, dentre outros, na Idade Moderna, por Descartes (1996, p. 65) ("animal-máquina") e busca dar novas luzes à dimensão conflituosa e perene da relação Homem e Natureza, como destaca o Papa Francisco. Constitui-se, pois, em nova forma de visualização da questão ambiental trazida pela filosofia contemporânea (environmental ethics), que não pode ser desprezada pelo Direito ambiental brasileiro. Surge a necessidade de evolução normativa para uma visão ecológica integrativa do homem, dos animais, das plantas e dos elementos não-vivos do ecossistema, mutatis mutandi, como ocorreu com a transformação do conceito de personalidade jurídica, antes restrito exclusivamente ao ser humano. A pandemia ligada a COVID-19 realça a necessidade de políticas públicas centradas na visão macroética ecocêntrica integral que na visão do One Health busque soluções ecossistêmicas para os problemas sanitários humanos integrando, por exemplo, a medicina tradicional com a veterinária e a ecologia.

Sendo o Estado Socioambiental regido pelos princípios da solidariedade e da democracia participativa, primordiais para o deslinde das questões ambientais, a mediação, em virtude de suas características, acaba por permitir, no âmbito dos procedimentos ambientais, a maior e mais efetiva participação da sociedade (por meio da ação comunicativa), desvelando a promoção da cidadania ambiental na defesa e preservação dos bens ambientais, passando o Ministério Público brasileiro a ser um importante indutor (agente de transformação social) na efetiva defesa e preservação do direito fundamental ambiental. Nessa esteira, a obra acaba por se apresentar relevante para vários setores da sociedade, âmbito público e privado, por permitir a todos, indistintamente, a possibilidade de envidar esforços efetivos na compreensão e construção da realização da Justiça ambiental.

The global commons have always been understood as geographical spaces that exist only outside the political borders of states. A vital good such as a stable climate exists both within and outside all states, and shows traditional legal approaches to be ecological nonsense. With the recent possibility of measuring and monitoring the state and functioning of the Earth System through the Planetary Boundaries framework, it is now possible to define a “Safe Operating Space of Humankind” corresponding to a biogeophysical state of Earth. In this sense, the Common Home of Humanity is not a planet with 510 million square kilometres, but is a specific favourable state of the Earth System. Recent major scientific advances anticipate a legal paradigm shift that could overcome the disconnection between ecological realities and existing legal frameworks. If we recognize this qualitative and non-geographic space as a Common Natural Intangible Heritage of Humankind, all positive and negative “externalities” end up being included within a new maintenance system of the Common Home.
