Book Synopsis Political Theory in Modern Germany by : Chris Thornhill
Download or read book Political Theory in Modern Germany written by Chris Thornhill and published by John Wiley & Sons. This book was released on 2013-06-10 with total page 487 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides an accessible and comprehensive introduction to the major political thinkers of modern Germany. It includes chapters on the works of Max Weber, Carl Schmitt, Franz Neumann, Otto Kirchheimer, Jurgen Habermas and Niklas Luhmann. These works are examined in their social and historical contexts, ranging from the period of Bismarck to the present day. A clear picture is presented of the connections between individual theoretical positions and the general political conditions of modern Germany. Areas of political history covered in particular depth include nineteenth-century legal and parliamentary history, aspects of German liberalism, Weimar social democracy, political Catholicism, Adenauer and Erhard, Brandt's reforms and the Tendenzwende of the late 1970s. By closely linking intellectual and political history, this work examines how recent German political theory has developed as a set of varying responses to recurring aspects and problems of political life in modern Germany. At the same time, it addresses the philosophical and political implications of the works which it treats, and it critically examines how modern German political theory has contributed to broader attempts to theorize political legitimacy and politics itself. This book will be of interest to students of political theory, German studies and European political history.
Book Synopsis Reconsidering Constitutional Formation II Decisive Constitutional Normativity by : Ulrike Müßig
Download or read book Reconsidering Constitutional Formation II Decisive Constitutional Normativity written by Ulrike Müßig and published by Springer. This book was released on 2018-05-25 with total page 425 pages. Available in PDF, EPUB and Kindle. Book excerpt: This second volume of ReConFort, published open access, addresses the decisive role of constitutional normativity, and focuses on discourses concerning the legal role of constitutional norms. Taken together with ReConFort I (National Sovereignty), it calls for an innovative reassessment of constitutional history drawing on key categories to convey the legal nature of the constitution itself (national sovereignty, precedence, justiciability of power, judiciary as constituted power). In the late 18th and early 19th centuries, constitutional normativity began to complete the legal fixation of the entire political order. This juridification in one constitutional text resulted in a conceptual differentiation from ordinary law, which extends to alterability and justiciability. The early expressions of this ‘new order of the ages’ suggest an unprecedented and irremediable break with European legal tradition, be it with British colonial governance or the French ancien régime. In fact, while the shift to constitutions as a hierarchically ‘higher’ form of positive law was a revolutionary change, it also drew upon old liberties. The American constitutional discourse, which was itself heavily influenced by British common law, in turn served as an inspiration for a variety of constitutional experiments – from the French Revolution to Napoleon’s downfall, in the halls of the Frankfurt Assembly, on the road to a unified Italy, and in the later theoretical discourse of twentieth-century Austria. If the constitution states the legal rules for the law-making process, then its Kelsian primacy is mandatory. Also included in this volume are the French originals and English translations of two vital documents. The first – Emmanuel Joseph Sieyès’ Du Jury Constitutionnaire (1795) – highlights an early attempt to reconcile the democratic values of the French Revolution with the pragmatic need to legally protect the Revolution. The second – the 1812 draft of the Constitution of the Kingdom of Poland – presents the ‘constitutional propaganda’ of the Russian Tsar Alexander I to bargain for the support of the Lithuanian and Polish nobility. These documents open new avenues of research into Europe’s constitutional history: one replete with diverse contexts and national experiences, but above all an overarching motif of constitutional decisiveness that served to complete the juridification of sovereignty. Book Synopsis The 'Militant Democracy' Principle in Modern Democracies by : Markus Thiel
Download or read book The 'Militant Democracy' Principle in Modern Democracies written by Markus Thiel and published by Routledge. This book was released on 2016-02-17 with total page 475 pages. Available in PDF, EPUB and Kindle. Book excerpt: This collection provides an up-to-date analysis of key country approaches to Militant Democracy. Featuring contributions from some of the key people working in this area, including Mark Tushnet and Helen Irving, each chapter presents a stocktaking of the legal measures to protect the democracy against its enemies within. In addition to providing a description of the country's view of Militant Democracy and the current situation, it also examines the legal and political provisions to defend the democratic structure against attacks. The discussion also presents proposals for the development of the Militant Democracy principle or its alternatives in policy and legal practice. In the final chapter the editor compares the different arrangements and formulates a minimum consensus as to what measures are indispensable to protect a democracy. Highly topical, this book is a valuable resource for students, academics and policy-makers concerned with democratic principles.
