Book excerpt: The Migration Age is still envisioned as an onrush of expansionary "Germans" pouring unwanted into the Roman Empire and subjecting it to pressures so great that its western parts collapsed under the weight. Further developing the themes set forth in his classic Barbarians and Romans, Walter Goffart dismantles this grand narrative, shaking the barbarians of late antiquity out of this "Germanic" setting and reimagining the role of foreigners in the Later Roman Empire. The Empire was not swamped by a migratory Germanic flood for the simple reason that there was no single ancient Germanic civilization to be transplanted onto ex-Roman soil. Since the sixteenth century, the belief that purposeful Germans existed in parallel with the Romans has been a fixed point in European history. Goffart uncovers the origins of this historical untruth and argues that any projection of a modern Germany out of an ancient one is illusory. Rather, the multiplicity of northern peoples once living on the edges of the Empire participated with the Romans in the larger stirrings of late antiquity. Most relevant among these was the long militarization that gripped late Roman society concurrently with its Christianization. If the fragmented foreign peoples with which the Empire dealt gave Rome an advantage in maintaining its ascendancy, the readiness to admit military talents of any social origin to positions of leadership opened the door of imperial service to immigrants from beyond its frontiers. Many barbarians were settled in the provinces without dislodging the Roman residents or destabilizing landownership; some were even incorporated into the ruling families of the Empire. The outcome of this process, Goffart argues, was a society headed by elites of soldiers and Christian clergy—one we have come to call medieval.

That will mark an end to his professional career as Researcher and Lecturer on a Royal Netherlands Academy of Arts and Sciences post (1989–1999), as Professor Extraordinarius at the Theological Faculty of the University of Utrecht (1997–2006), and as Professor on the Chair of Legal History at the Vrije Universiteit Amsterdam (from 1999 onwards). These positions reflect two focal points of his research: on the one hand Church history and Canon Law, on the other hand classical and particularly medieval Roman law and their history. They matched very felicitously his engagement for and in the Old-Catholic Church. The contributions centre on the themes and questions the honorand has pursued in his work till now.

Propaganda, school curricula, and academic publications under the regime drew spurious conclusions from archaeological evidence to glorify the Germanic past and proclaim chauvinistic notions of cultural and racial superiority. But was this powerful and violent version of the distant past a nationalist invention or a direct outcome of earlier archaeological practices? By exploring the myriad pathways along which people became familiar with archaeology and the ancient past—from exhibits at local and regional museums to the plotlines of popular historical novels—this broad cultural history shows that the use of archaeology for nationalistic pursuits was far from preordained. In Germany’s Ancient Pasts, Brent Maner offers a vivid portrait of the development of antiquarianism and archaeology, the interaction between regional and national history, and scholarly debates about the use of ancient objects to answer questions of race, ethnicity, and national belonging. While excavations in central Europe throughout the eighteenth and nineteenth centuries fed curiosity about the local landscape and inspired musings about the connection between contemporary Germans and their “ancestors,” antiquarians and archaeologists were quite cautious about using archaeological evidence to make ethnic claims. Even during the period of German unification, many archaeologists emphasized the local and regional character of their finds and treated prehistory as a general science of humankind. As Maner shows, these alternative perspectives endured alongside nationalist and racist abuses of prehistory, surviving to offer positive traditions for the field in the aftermath of World War II. These essays by Floyd Seyward Lear analyze the development of the political theory of treason from its beginning in Roman Law to its transformation in the Germanic custom of the early Middle Ages. The author has presented treason as a political idea, possessing historical continuity, though varying from age to age as it follows the evolution of political authority itself. These studies trace the shifting emphasis in crimes against the state from acts directed against a central absolutist authority to acts involving the personal relationship of a pledged troth and individual fealty. This is a shift from the concept of majesty in Roman law to the concept of fidelity in Germanic law with the corollary shift from allegiance as an act of deference to allegiance as a token of mutual fidelity. These ideas are examined chronologically across an interval extending from archaic Roman law to incipiently feudal forms, from which modern theories of treason, allegiance, and sovereignty derive. Contemporary concepts in these political areas can hardly be understood apart from their historical origins. Broadly considered, this work is intended as a contribution to intellectual history. Further, this collection represents the synthesis of material widely scattered in the primary sources and relevant secondary works. The two concluding bibliographical essays are intended as a general survey of the literature relevant to these studies in Roman and Germanic public law. Descriptive and interpretive works which deal with treason and its allied aspects of political and legal theory are not numerous in the English language.
