Die Moral und das Recht haben in der Willensfreiheit ihre Voraussetzungen. Der freie Wille ist theoretisch nicht beweisbar, vielmehr kann er durch die bloß theoretische Betrachtung nur widerlegt werden, oder aber die Frage nach der Willensfreiheit bleibt unentschieden. Unter einer naturwissenschaftlichen Betrachtungsweise kann es nur materialistisch-monistische Widerlegungen der Willensfreiheit geben, die umso einfacher zu leisten sind, je reduktionistischer die naturwissenschaftliche Betrachtungsweise geführt wird. Die erkenntniskritische Sicht auf den freien Willen kann hingegen nur feststellen, dass dieser, so wie die Existenz Gottes oder die Unsterblichkeit der Seele, weder zu beweisen noch zu widerlegen ist, da die Frage nach der Willensfreiheit das Erkenntnisvermögen des menschlichen Verstandes überschreitet. In praktischer Hinsicht muss der freie Wille postuliert werden, damit Menschen als Personen, moralisch und rechtlich zurechnungsfähige Wesen, behandelt werden können, und damit moralphilosophische Wertungen und ethische Urteile einen Sinn ergeben, denn sie beziehen sich auf den Begriff der Person, der ohne die Willensfreiheit ein leerer Begriff wäre. Hier soll kein weiterer Versuch unternommen werden, den freien Willen zu beweisen. Vielmehr sollen hier die ontologischen Konsequenzen der Willensfreiheit untersucht werden: wie muss eine menschliche Person ontologisch beschaffen sein? Diese Frage ist sinnvoll, da ein freier Wille zur Folge hat, dass etwas Immaterielles - der freie Wille, der sich verpflichtet, sich an moralische Gebote zu halten, - physische Handlungen verursachen können muss. Um dies zu können, muss ein immaterieller Teil des Menschen real existieren, was ontologisch die Existenz der Seele erfordert. Dieser immaterielle Teil muss mit dem materiellen Teil ein einheitliches Ganzes bilden, um ein unteilbares menschliches Individuum zu erzeugen.
