Die Philosophie des achtzehnten Jahrhunderts definierte den Begriff Demokratie (griechisch: Volksherrschaft) als „[...] jene institutionelle Ordnung zur Erzielung politischer Entscheide, die das Gemeinwohl dadurch verwirklicht, dass sie das Volk selbst die Streitfragen entscheiden lässt und zwar durch die Wahl von Personen, die zusammenzutreten haben, um seinen Willen auszuführen.“ Im praktischen Vollzug stellte sich diese Definition jedoch als problematisch heraus. Das Hauptproblem der klassischen Theorie ist, dass dem einzelnen ein wirklichkeitsfremdes Ausmaß von Initiative beigelegt, der Normalbürger als rational denkender und handelnder politischer Faktor schlicht überschätzt wird. Daher wurde von Schumpeter eine alternative Theorie hervorgebracht, welche Demokratie nicht nach dem Wortsinn definiert. Die Hauptaufgabe des Volkes besteht laut Schumpeter darin, eine Regierung hervorzubringen. Die demokratische Methode ist hier „[...] diejenige Ordnung der Institutionen zur Erreichung politischer Entscheidungen, bei welcher einzelne die Entscheidungsbefugnis vermittels eines Konkurrenzkampfs um die Stimmen des Volkes erwerben.“ Demokratie bedeutet hier also nicht, dass das Volk die Herrschaft ausübt, sie gibt dem Volk vielmehr nur die Möglichkeit, seine(n) Herrscher am Wahlsonntag zu akzeptieren oder abzulehnen. Demokratie und Wahlen stehen also in einem engen Zusammenhang. Das Volk, die wahlberechtigten Bürger, entscheiden über die politische Machtverteilung und legitimieren sie somit. In den letzten Jahren ist in der BRD (wie in einigen anderen westlichen Industriegesellschaften auch), die Wahlbeteiligung stark zurückgegangen. Dies ist insofern beunruhigend, da Wahlen nicht nur die Grundlage des liberalen Demokratieverständnisses bilden, sondern auch für die breite Masse der Bevölkerung die einzige Form der Teilnahme am politischen Prozess darstellen. Ist diese Form der Regierungsbildung überhaupt noch demokratisch zu nennen, wenn teilweise nur noch drei von fünf Wahlberechtigten zur Wahl gehen und die stärkste Regierungspartei Rückhalt lediglich bei einem Viertel der Wahlbevölkerung findet, während zwei Fünftel tatenlos zuschauen? How to Save a Constitutional Democracy mounts an urgent argument that we can no longer afford to be complacent. Drawing on a rich array of other countries’ experiences with democratic backsliding, Tom Ginsburg and Aziz Z. Huq show how constitutional rules can both hinder and hasten the decline of democratic institutions. The checks and balances of the federal government, a robust civil society and media, and individual rights—such as those enshrined in the First Amendment—often fail as bulwarks against democratic decline. The sobering reality for the United States, Ginsburg and Huq contend, is that the Constitution’s design makes democratic erosion more, not less, likely.
