Book excerpt: This collection of essays analyzes different iterations of African unity, exploring the political and cultural visions that informed projects aimed at African unification. It explores the cultural, economic and non-state aspects of the Organisation of African Unity (OAU) as the principal institution dedicated to the cooperation of African states, from its establishment in 1963 to its transformation into the African Union (AU) in 2000, as well as how ideas of African unity shaped the Cold War and African liberation struggles. Bringing together contributors from a diverse range of disciplinary backgrounds across Africa, Europe and the US, this book investigates the ideological origins and historiography of Pan-African and unification projects, and considers how African intellectuals, leaders and populations engaged with these ideas.

This book was released on 2023-09-28 with total page 173 pages. Available in PDF, EPUB and Kindle. Book excerpt: This research evaluates whether the new model of investment agreement developed by Brazil (CFIA) is a mechanism for enhancing protection and respect for social and economic rights. The research starts by exploring the origins of investment treaties, their development and main characteristics. It examines why investment treaties and socio-economic rights are related, by mapping cases in which investment treaties have already impaired the protection of such rights. The research then analyzes how these two issues shall be jointly handled. It considers international organizations? initiatives to regulate business and human rights and investment treaties? frameworks that foster sustainable development, as well as new investment agreements? models developed by different countries, and then suggests criteria for evaluating whether an investment treaty is adequate from the socio-economic rights standpoint. Finally, this research investigates the CFIA model, brings a brief historical overview, evaluates CFIAs? wording, and examines how some CFIAs? institutional mechanisms consider corporate social responsibility issues. In conclusion, this research asserts that the CFIA model can be a mechanism for enhancing protection and respect for socio-economic rights, but some concerns (particularly related to safeguarding States? regulatory space and providing for stronger obligations to investors and States to protect human rights) need to be addressed.

Available in PDF, EPUB and Kindle. Book excerpt: The Unwritten Brazilian Constitution offers an unexplored topic outside Portuguese language: the leading cases on human rights in the Brazilian Supreme Court (Supremo Tribunal Federal – STF). The Brazilian Constitution of 1988 represents an institutional framework able to restructure the relationship between the powers after the military dictatorship. The constituents drafted the Brazilian Constitution in order to set an extensive system of judicial protection for fundamental rights, by means of several instruments that have strengthened access to the Judiciary. Because the Brazilian Constitution has an extensive list of fundamental rights, the STF was called to interpret them several times and it developed an unwritten understanding of these fundamental rights. These decisions are not available to the international community since they are not translated to English. Based on this gap, this original book illustrates the main rulings on human rights analyzed by great scholars in Brazil. The text presents a deep discussion regarding the characteristics of the cases and demonstrates how the STF has built the legal arguments to interpret the extension of the fundamental rights.

Book excerpt: This book makes a valuable contribution to the fascinating global debate on the meaning and scope of freedom of religion or belief and the relations between state, society and religion. It offers a cross-thematic approach to law and religion from the Global South. Law and religion have been consolidated to form a specific area of study in recent years. However, due to language barriers, most of the regional and national debates within Latin America have not been accessible to interested audiences from other parts of the world. Despite the specificities of the Latin American context, the issues, arrangements and processes that have been negotiated and developed in this part of the Global South make a valuable contribution to addressing the challenges that have arisen in other regions. The book analyses the intersections and interactions between religion and other far-reaching subjects such as politics and democracy, traditional cultures, national and ethnic groups, majorities and minorities, public education, management of diversity, intolerance and violence, as well as secularism and equality. The collection of essays is of interest not only to legal scholars and practitioners, but also to sociologists, political scientists and theologians, as well as to policymakers and civil society organizations.

This book was released on 2012-02-13 with total page 311 pages. Available in PDF, EPUB and Kindle. Book excerpt: In contemporary armies, violence among soldiers seems to be a universal phenomenon found in both professional and drafted armies. However, the comparison of violent practices in various armies around the world allows us to identify specific features linked to those countries' sociological, political or anthropological contexts. Hazing, for example, seems to be more violent in the armies of transitional societies (Russia, Eastern Europe, Latin America), where social tensions encountered by citizens in their daily lives are carried over to, and sometimes intensified in, the military. The comparison of Russian dedovshchina with the situation in other countries makes it possible to identify universal, transitional and national characteristics of military violence.Contents: Konstantin Bannikov on the consequences of the spread throughout society of archaic violence produced by the Russian army; Anna Colin Lebedev on the perception of military violence in Russian society; Anton Oleynik on informal relationships among prisoners and conscripts; Kirill Podrabinek on the reasons of the prevalence of dedovshchina in the post-Soviet context; Igor Obraztsov on the historical roots of dedovshchina; Vadim Mikhailin on the role of language in the military milieu; Julie Elkner on the Committee of Soldiers’ Mothers; Bakit Katchekeyev on hazing in the Kyrgyz army; Irakli Sesiashvili on hazing in the Georgian army; Hana Cervinkova on hazing in the Czech army; James Wither on bullying in the British army; Eduardo Paes-Machado & Carlos Linhares de Albuquerque on hazing in the Brazilian police; Joris Van Bladel on dedovshchina and the all-volunteer force.
