Book excerpt: Mary Ann Sternberg has woven together history, tales, anecdotes, and personal experiences to create a fascinating narrative on Bayou Manchac, an overlooked treasure of Louisiana. Only eighteen miles in length, Bayou Manchac has a history that far exceeds it's physical longevity. It has been one of the most important waterways in the southeastern United States and a vital link in a shortcut passage from the Mississippi River to the Gulf of Mexico. Native Americans flourished here from about 250 B.C. until they introduced the bayou to Iberville, the founder of Louisiana, in 1699. French voyagers.
Book Synopsis The Juridical Act by : H. D. S. van der Kaaij
Download or read book The Juridical Act written by H. D. S. van der Kaaij and published by Springer. This book was released on 2019-06-13 with total page 190 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book puts forward a new theoretical concept of the juridical act, this concept is not described from the perspective of a specific national legal system, but instead represents the commonalities and ideas that stem from the Western legal tradition. Since the concept is system-independent, it does not rely on national or state laws. The book begins by detailing those characteristics that distinguish juridical acts from the general group of acts. It offers clear distinctions between the different aspects of juridical acts, such as the power and the competence needed in order to perform the act, the fact that juridical acts are constitutive speech acts, and the rules that connect the act with its consequences. In the process, the book dispels much of the haziness currently surrounding juridical acts. Developed with a mix of theory and practice, this new concept is better equipped to deal with modern trends and practices. Further, since the author has freed the idea of the juridical act from the bonds of history and geography, it is also more suited to facilitating a better understanding of and explaining changes in the legal landscape, such as the rise of computer technology. Accordingly, it offers scholars and practitioners alike a valuable new tool for explaining and theorizing about the law.

Book Synopsis The French Law of Contract by : Barry Nicholas
Download or read book The French Law of Contract written by Barry Nicholas and published by OUP Oxford. This book was released on 1992 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Written primarily for lawyers and law students in the Common law world, this book assumes no prior knowledge of French law. Beginning with an introductory account of the characteristics of French law and the French legal system, it looks at the principles of the French law of contract from the standpoint of a Common lawyer familiar with the problems with which the law of contract has to deal in a modern Western society. Its arrangement follows that of the French law, but the French concepts and rules are set out in relation to their counterparts in the Common law. Consideration is given to recent developments in matters such as the obligation to disclose information, third party rights in 'groups of contracts', unfair contract terms, and the seller's liability for latent defects.
Book Synopsis European Contract Law by : Bénédicte Fauvarque-Cosson
Download or read book European Contract Law written by Bénédicte Fauvarque-Cosson and published by Walter de Gruyter. This book was released on 2009-04-27 with total page 649 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Association Henri Capitant des Amis de la Culture Juridique Française and the Société de législation comparée joined the academic network on European Contract Law in 2005 to work on the elaboration of a "common terminology" and on "guiding principles" as well as to propose a revised version of the Principles of European Contract Law (PECL). The results of this work were sent to the European Commission and have already been published in French. The English translation is now being published by sellier.elp. This work could contribute to the wider European project. The part on the guiding principles could be a component of the CFR, in the form of "black letter" model rules or recitals. The part on terminology is, in itself, useful for the elaboration of the final various linguistic versions of the CFR. It finds its place within the materials which will accompany the model rules. Last but by no means least, the revised version of the PECL should be considered by the European institutions as an alternative set of model rules on contract law.
