If we accept such compatibility, what is the actual content of cultural rights? Who are their beneficiaries: individuals, or peoples or groups as collective entities? And what precise obligations do cultural rights pose upon states or other actors in international law, or for the international community as a whole? International instruments on the protection of human rights do not provide self-evident answers to these questions. This book seeks to analyse these dilemmas and to assess the impact that they are having on international law and the development of a coherent category of cultural human rights.

El objetivo de este libro es evaluar los desafíos que enfrentan las instituciones internacionales en la protección de los derechos económicos, sociales y culturales. Más específicamente, busca detectar diferentes patrones en dos tipos de actores que incluyen las instituciones financieras internacionales y las instituciones del sistema universal, como la Agencia de la Organización de las Naciones Unidas para los Refugiados. La metodología incluye un diseño de investigación documental comparativo y la evaluación de estudio de casos. Esto incluye una evaluación de varios casos que analizan el papel de las instituciones internacionales y su interacción con los derechos humanos. Intentar encontrar patrones comunes en diferentes estructuras y procesos nos da alguna indicación, una imagen del tipo de problemas que estas instituciones enfrentan actualmente. Los casos estudiados en esta investigación revelan una serie de desafíos que enfrentan dichas instituciones que van desde el fortalecimiento de aspectos organizacionales y estratégicos hasta, en general, el fortalecimiento de la capacidad institucional. Sin embargo, el principal desafío encontrado es el desarrollo de la reflexividad institucional intencional. Esto implica la adopción, por parte de las instituciones internacionales, de una nueva orientación hacia principios y valores. La promoción de este nuevo enfoque debe comenzar con una reestructuración completa a nivel mundial.

Book excerpt: This book offers a comprehensive analysis of the legal issues around intangible cultural heritage (also known as traditional cultural expressions or folklore). It explores both institutional and substantive responses the law offers to the safeguarding of intangible heritage, relying heavily on critiques internal and external to the law. These external critiques primarily come from the disciplines of anthropology and heritage studies. Intangible cultural heritage is safeguarded on three different levels: international, regional, and national. At the international level, the foremost instrument is the specific UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage (2003). At the regional level, initiatives are undertaken both in schemes of political and economic integration, a common thread being that intangible cultural heritage helps promote a common identity for the region, becoming thus a desirable aspect of the integration process. Domestically, responses range from strong constitutional forms of protection to rather weak policy initiatives aimed primarily at attracting foreign aid. Intangible heritage can also be safeguarded via substantive law, and, in this respect, the book looks at the potential and pitfalls of human rights law, intellectual property tools, and contractual approaches. It investigates how the law works and ought to work towards protecting communities, defined as those from where intangible cultural heritage stems, and to whom benefits of its exploitation must return. The book takes the critiques from anthropological and heritage studies into account in order to posit a re-shaped law, offering tools that can be valuable to both scholars and practitioners when understanding how to safeguard intangible heritage.

Documents on Autonomy and Minority Rights offer examples of some of the unique structures which have been developed to respond to geographic, political, ethnic, linguistic, and other differences under a single sovereignty. They present a broad spectrum of domestic constitutional provisions, statutes, and political agreements, as well as a comprehensive collection of relevant international instruments. The first section includes documents adopted on a global or regional basis to set standards for the protection of minority rights and the rights of indigenous peoples. The second section includes a wide range of national documents related to minority rights and/or autonomy. The last section contains historical documents. The author has written a brief introduction to each document to give the reader unfamiliar with the situation to which a document pertains enough information to consider its context. No single text can be used as a model of autonomy, for every situation is unique. At the same time, however, greater knowledge of a broad range of successful and unsuccessful arrangements may inspire new ideas with which to address conflicts which have claimed tens of thousands of lives in recent years. At the very least, the ingenuity evidenced in some of the documents should encourage experimentation and underscore the need of going beyond the mere recitation of definitions of federalism, consociation, devolution, or other constitutional models. The great variety of institutional arrangements, the detailed provisions developed to resolve particularly difficult local problems, and the flexibility in addressing issues such as revenue-sharing or participation in international organizations, demonstrate that neither "sovereignty" nor "self-determination" need stand in the way of innovative solutions.
