Book excerpt: This book contends that the right of access to justice (at national and international levels) constitutes a basic cornerstone of the international protection of human rights, and conforms a true right to the Law. It amounts, lato sensu, to the right to the realization of justice. In such understanding, it comprises not only the formal access to a tribunal or judge, but also respect for the guarantees of due process of law, the right to a fair trial, and to reparations (whenever they are due), and the faithful execution of judgments. On its part, the right to an effective domestic remedy is a basic pillar of the rule of law in a democratic society. In its part, the right of international individual petition, together with the safeguard of the integrity of international jurisdiction, constitute the basic foundations of the emancipation of the individual vis-à-vis his own State. This is a domain that has undergone a remarkable development in recent years. It is submitted that the right of access to justice belongs today to the domain of jus cogens. Without it, there is no legal system at all. The protection of the human person in the most adverse circumstances has evolved amongst considerations of ordre public. Such recent evolution has been contributing to the gradual expansion of the material content of jus cogens. Furthermore, the very notion of "victim" (encompassing direct, indirect and potential victims) has been the subject of a considerable international case-law. Victims have had their cause vindicated in situations of utmost adversity, if not defencelessness (e.g., abandoned or "street children", undocumented migrants, members of peace communities in situations of armed conflict, internally displaced persons, individuals in infra-human conditions of detention, surviving victims of massacres).

It highlights the ways in which xenophobic mechanisms naturalize harsh working and living conditions. The volume opens new horizons regarding novel migratory territories recently built by Bolivian laborers in Argentina. It collects the results of longstanding anthropology studies in different Provinces: Buenos Aires, Córdoba, Mendoza, Río Negro, Salta, and Tierra del Fuego. It refers to the trajectories of some Bolivians who had previously migrated to Spain and returned to Argentina after the European crisis in 2008. It also compares the south-south labor migration from Bolivia to Argentina, with the north-north one from Tajikistan to the Russian Federation. Bolivian Labor Immigrants' Experiences in Argentina highlights key issues regarding the structural factors that pattern the integration of Bolivian immigrants in certain labor markets segmented by inequalities based on class, gender, “ethny-race”, nationality, and migratory and legal status. It provides ethnographic insights about the various ways in which Bolivian immigrants experience harsh living and working conditions. Finally, it helps to understand that these men and women are capable of dealing with oppressive situations and of performing particular ways of resistance. The focus on labor migrants does not lead to a reductionist economic analysis of their trajectories, experiences, and prospects for the future. On the contrary, they are studied from a holistic anthropological approach, considering that migrants make sense of their territorial mobility from complex points of view anchored in their life experiences. Therefore, contributors consider that migration is a process that involves economic, social, cultural, and political dimensions

Book excerpt: La tesis de la investigadora, defendida en 2017 en la Universidad de Deusto y dirigida por los profesores Felipe Gómez Isa y Carlos Martín Beristain, analiza el que califica de “conflicto olvidado” del Sahara Occidental desde la perspectiva de los derechos humanos abordando, en particular, el delito de desaparición forzada. Para ello, la autora, que formó parte del equipo de trabajo de la investigación que desembocó en “El Oasis de la Memoria”, analiza en detalle 95 casos de desaparición forzada, 86 de ellos recogidos en dicha publicación y los nueve restantes, en “Meheris: la esperanza posible”. La investigadora indica que es necesaria “una voluntad política real por transformar la realidad y romper con el pasado de violaciones de derechos humanos” y denuncia que “no se haya respetado el derecho de las víctimas a la verdad”. Los resultados del trabajo, según apunta López, se espera que sirvan para que las personas afectadas puedan defender sus derechos ante las instancias internacionales y la Audiencia Nacional española.
