Su enfoque está orientado en resaltar los antecedentes históricos del surgimiento de los derechos fundamentales a partir de la independencia de los Estados Unidos de 1776 en un contexto revolucionario "iusfilosófico" y político de tipo económico localista, que no tuvo trascendencia regional dentro del Continente Americano, solamente, en la forma de gobierno presidencialista fundado en la república. Carl Schmitt, resalta el hecho histórico del carácter originalista de la noción conceptual de los derechos fundamentales en los Estados Unidos de Norteamérica, contraponiéndolo con los intentos particularistas invocados en los referentes históricos contenidos en la Magna Carta del año 1215 d.C., otorgada por el monarca Juan sin Tierra; el Acta de Habeas Corpus de 1679 (protección contra prisiones arbitrarias y derecho a ser oído por el juez); y, la Carta The Bill of Rights de 1688, como instrumentos jurídicos que ofrecen un tipo de garantías procesales que tienen un rango de normas "pre-constitucionales", pero, conforme con su radio de protección, estos instrumentos estaban "limitados" y "re-dirigidos" a ciertos grupos sociales o destinatarios individualistas. Por tanto, estos instrumentos son "excluyentes" y carecen de un carácter universalista en el ámbito de protección de las dimensiones "objetiva" y "subjetiva" que comprenden la esfera de la dignidad humana de "toda-persona", sin distinción de clase, raza o color. Desde la perspectiva de los antecedentes históricos de la definición de los derechos fundamentales, los constructos categóricos que fungieron como principios y valores axiológicos de la revolución mercantilista de los EE.UU., la "aproximación" más cercana a lo que, el Estado Constitucional proclama y define como "derecho-fundamental", señala Schmitt, fue emitida por el Estado de Virginia en 12 de junio de 1776, siguiéndole Pensylvania (11 de noviembre de 1776) y otros, y posteriormente incorporados como Amendments en 1789-1791).
