Presenta el derecho humano a la identidad cultural como un derecho en común, americano y europeo, sustentado en un núcleo convergente en unas mismas fuentes de derechos humanos de carácter universal. Asimismo, explica cómo este derecho es elevado a un valor que caracteriza las democracias europeas y americanas. Paralelamente, la obra desarrolla los alcances de las doctrinas interpretativas de cada tribunal, el Control de Convencionalidad de la Corte IDH y el Margen de Apreciación Nacional del TEDH. Así, el libro señalará que el principal desafío en torno al derecho humano a la identidad cultural radica en avanzar hacia una reflexión compartida que pueda alcanzar un entendimiento armonizable de la cuestión de la competencia de supervisión jurisdiccional internacional de cada tribunal, regida por el principio de subsidiariedad (enlazado a complejas estrategias de cohabitación, de gramáticas y arquitecturas históricas y políticas bien distintas en cada caso). Frente a este nudo, plantea que una mirada dialógica para la supervisión jurisdiccional internacional en el ámbito del TEDH y de la Corte IDH, puede colaborar, mutuamente, al reforzamiento de los estándares de cumplimiento relativos al derecho humano a la identidad cultural.
