Una filosofía constitucional pretende brindar un punto de vista para articular coherentemente algunos de los ingredientes esenciales de una constitución democrática y liberal, los derechos fundamentales, el gobierno popular y la jurisdicción constitucional. En este libro se analizan tres modelos de filosofía constitucional, bajo el entendido de que será exitoso aquel que armonice sus piezas con el propósito de aliviar las tensiones internas que le aquejan, como la que desemboca en la objeción contramayoritaria a la judicial review y en el problema de la llamada "última palabra". Tras el análisis y crítica de esos modelos, la obra se decanta por un constitucionalismo de corte deliberativo (denominado "equilibrado") que subraya la naturaleza político-discursiva de los derechos, la necesidad de operar ajustes institucionales para incrementar el potencial deliberativo de las decisiones de Estado, así como la relevancia de una justicia constitucional de carácter débil. La filosofía constitucional deliberativa se opone así al constitucionalismo sustantivista, coincidente con esquemas institucionales de jurisdicción constitucional fuerte, y al constitucionalismo procedimentalista, compatible con sistemas de carácter parlamentario. Leopoldo Gama Abogado mexicano y doctor en derecho por la Universidad de Alicante (España). Su trabajo académico se centra en el área de los tribunales constitucionales y la aplicación judicial de los derechos. Fue coordinador del libro Derechos políticos y democracia en México (2015) y de Diálogos para la justicia abierta (2017). En el Tribunal Electoral del Poder Judicial de la Federación (México) ha ocupado cargos en áreas jurisdiccionales y de formación judicial. Adicionalmente, se ha desempeñado en el ámbito docente como profesor a nivel licenciatura en derecho y posgrado de Teoría del Derecho, Derecho Constitucional, Interpretación Constitucional y Argumentación Jurídica.

The Latin American «Amparo» Proceeding, is the original version of the text I wrote for the Couse of Lectures I gave, as Adjunct Professor of Law, on a Seminar on Judicial Protection of Fundamental Rights in Latin America: the Amparo Proceeding, at the Columbia Law School in New York, University of Columbia, during the years 2006-2008. The Seminar was intended to examine the most recent trends in the constitutional and legal regulations in all Latin American countries regarding the “amparo” suit, action or recourse– including the old habeas corpus writ and the new habeas data actions or recourses. By means of a comparative constitutional law approach, also with reference to the United States civil rights injunctions, the Course analyzed this Latin American institution departing from the regulation of the “amparo” guarantee established in Article 25 of the 1969 American Convention of Human Rights which entered into force in 1978 after being ratified by all Latin American States. The amparo suit or proceeding is not only an effective judicial means for the restoration of the injured constitutional rights that has been harmed, similar to the reparative or restorative civil rights injunctions in the United States, but it is also the effective judicial means for the protection of such rights and guaranties when threatened to be violated or harmed. This latter amparo suit is then similar to the preventive civil rights injunctions in the United States; “preventive” in the sense of avoiding harm; which, in this case, “seeks to prohibit some discrete act or series of acts from occurring in the future”, and is designed “to avoid future harm to a party by prohibiting or mandating certain behavior to another party”. From this point of view, thus, in a constitutional comparative law approach, the Latin American amparo action or proceeding, is a judicial remedy similar to the civil rights injunctions (restorative or preventive) in the United States". Sin embargo, muchos problemas persisten y la democracia dista de estar consolidada. La democratizacin en ambas sociedades, se ve confrontada con muchos problemas antiguos y por nuevos desaf os. Sin duda alguna la paz ha tenido un impacto en la democratizacin, pero algunas ireas han avanzado mis que otras y algunas pueden haberse incluso estancado. Existen diversos estudios individuales acerca de los procesos de negociacin e implementacin de la paz en Guatemala y El Salvador. Sin embargo, se ha escrito muy poco desde una perspectiva comparada. Ademis, se han llevado a cabo pocos anilisis integrales acerca del desarrollo democritico reciente en esos pa ses.
