Book Synopsis More Constitutional Dimensions of Contract Law by : Luca Siliquini-Cinelli
Download or read book More Constitutional Dimensions of Contract Law written by Luca Siliquini-Cinelli and published by Springer. This book was released on 2019-06-24 with total page 173 pages. Available in PDF, EPUB and Kindle. Book excerpt: This second volume on the constitutional dimension of contract law explores this increasingly relevant subject in jurisdictions that are usually overlooked by mainstream scholarship in the English-speaking world. With chapters on Finland and other Nordic Countries from a comparative perspective, Spain, Japan, Somalia, Nigeria, Brazil, and Peru, the contributions presented here offer much-needed, context-informed insights on whether – and if so, why, how and to what extent – the development of contract law is being influenced by constitutional values and fundamental rights issues (or vice-versa). The book represents a valuable addition to comparative law literature on the interplay between public (i.e., constitutional) and private (i.e., contract) law by revealing the inner dynamics through which these two branches interact and (at times) inform each other, whilst also enhancing our understanding of the law’s nature, function, and transformative potential at the macro, meso, and micro levels.

Download or read book Justicia e Internet, una filosofía del derecho para el mundo Virtual written by Anna MANCINI and published by BUENOS BOOKS AMERICA LLC. This book was released on 2004-03 with total page 278 pages. Available in PDF, EPUB and Kindle.
Book Synopsis Tort Law in Uruguay by : Mariana Barúa
Download or read book Tort Law in Uruguay written by Mariana Barúa and published by Kluwer Law International B.V.. This book was released on 2022-07-20 with total page 202 pages. Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this book provides ready access to how the legal dimension of prevention against harm and loss allocation is treated in Uruguay. This traditional branch of law not only tackles questions which concern every lawyer, whatever his legal expertise, but also concerns each person’s most fundamental rights on a worldwide scale. Following a general introduction that probes the distinction between tort and crime and the relationship between tort and contract, the monograph describes how the concepts of fault and unlawfulness, and of duty of care and negligence, are dealt with in both the legislature and the courts. The book then proceeds to cover specific cases of liability, such as professional liability, liability of public bodies, abuse of rights, injury to reputation and privacy, vicarious liability, liability of parents and teachers, liability for handicapped persons, product liability, environmental liability, and liability connected with road and traffic accidents. Principles of causation, grounds of justification, limitations on recovery, assessment of damages and compensation, and the role of private insurance and social security are all closely considered. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable resource for lawyers in Uruguay. Academics and researchers will also welcome this very useful guide, and will appreciate its value not only as a contribution to comparative law but also as a stimulus to harmonization of the rules on tort.

Book Synopsis Everyday Forms of Peasant Resistance by : Forrest D. Colburn
Download or read book Everyday Forms of Peasant Resistance written by Forrest D. Colburn and published by Routledge. This book was released on 2016-07-22 with total page 251 pages. Available in PDF, EPUB and Kindle. Book excerpt: Peasant rebellions are uncommon. "Everyday Forms of Peasant Resistance" explores peasants' foot dragging, feigned ingorance, false compliance, manipulation, flight, slander, theft, arson, sabotage, and similar prosaic forms of struggle. These kinds of resistance stop well short of collective defiance, a strategy usually suicidal for the subordinate. The central argument about peasant resistance is presented in the opening chapter by James Scott in which he summarizes and extends the thesis of his book on Malaysia's peasantry, "Weapons of the Weak". Scott's ideas are employed and refined in the ensuing seven country studies of peasant resistance: Poland, India, Egypt, Colombia, China, Nicaragua and Zimbabwe.
Book Synopsis ICSID Reports: Volume 5 by : Edward Helgeson
Download or read book ICSID Reports: Volume 5 written by Edward Helgeson and published by Cambridge University Press. This book was released on 2002-11-21 with total page 690 pages. Available in PDF, EPUB and Kindle. Book excerpt: The ICSID Reports provide the only comprehensive collection of the decisions of arbitral tribunals and ad hoc committees established under the auspices of the World Bank's International Centre for the Settlement of Investment Disputes. These decisions make an important contribution to the highly specialised jurisprudence on international investment. The series also includes arbitration under the Additional Facility to the ICSID Convention which has increased in recent years, most notably in relation to the North American Free Trade Agreement (NAFTA). The ICSID Reports are thus an invaluable tool for practitioners and scholars alike working in the field of international commercial arbitration. Volume 5 of the ICSID Reports brings the series substantially up-to-date to include important recent decisions from 1996 to 2000, including American Manufacturing & Trading v. Zaire, Azinian v. Mexico, Tradex Hellas v. Albania, Metalclad v. Mexico and Gruslin v. Malaysia.

Book Synopsis Human Rights Issues and Vulnerable Groups by : J. Alberto del Real Alcala
Download or read book Human Rights Issues and Vulnerable Groups written by J. Alberto del Real Alcala and published by Bentham Science Publishers. This book was released on 2017-11-13 with total page 312 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume covers topics related to human rights issues and problems of people who are overwhelmed by hostile situations around them and are subsequently rendered vulnerable. The situations of vulnerability discussed in this book are related to suffering caused by the moral, family, social, economic or political conditions in which the people, and the groups they belong to, live. Readers are guided through a discussion about rights, as an instrument through which civil society and the ‘Rule of Law’ try to curb or even eliminate the suffering of these people. The aim of such efforts is to restore the situation of vulnerable people to a level of normality. Human Rights Issues and Vulnerable Groups presents a discussion of issues surrounding several kinds of vulnerable groups: minorities, children, gender groups, persons with disabilities, migrants, cultural groups, displaced persons, victims of terrorism, linguistic groups, poor people, people in prison and sexual minorities. The book is a detailed reference for graduates and scholars in law, political science, sociology and social psychology. The volume is also recommended for working professionals who operate with human rights groups and general readers (non-experts) who want to understand the discourse about human rights in a holistic (moral, legal, social, economic, and political) framework.
