Die europäischen Politiker verordneten sich eine "Denkpause" um über das weitere Vorgehen zu beraten. Schon im Sommer 2007 begann dann die Arbeit an einem neuen EU-Vertrag, welcher die gescheiterte Verfassung ersetzen sollte. Am 13. Dezember 2007 unterzeichneten die europäischen Staats- und Regierungschefs den "Vertrag von Lissabon zur Änderung des Vertrags über die Europäische Union und des Vertrags zur Gründung der Europäischen Gemeinschaft" (im Folgenden: Reformvertrag). Dieser enthält viele Elemente der alten Verfassung und soll auch einen der Hauptkritikpunkte an der Europäischen Union ansprechen: den des vermeintlichen Demokratiedefizits der Union. Kritiker werfen der EU vor, dass sie von den europäischen Bürgern nicht demokratisch zur Verantwortung gezogen werden könne. Der EU und ihren Institutionen in Brüssel, Luxemburg und Straßburg mangele es an Gewaltenteilung, Transparenz und demokratischer Kontrolle durch die europäischen Bürger. Vor allem das europäische Parlament und die nationalen Parlamente hätten zu wenig Einfluss auf die Arbeit der Kommission und des Ministerrats. Die Legitimationsketten, welche von den nationalen Bürgern über die von ihnen gewählten Regierungen in die EU hineinreichen, seien zu lang um eine effektive demokratische Kontrolle der EU zu gewährleisten.
