Ebenso können Neuentwürfe notwendig sein, um die bis dato unvorhersehbaren gesellschaftlichen oder technischen Entwicklungen in einen Gesetzesrahmen zu bringen. Aktuelle Beispiele hierfür sind die Datenschutz-Grundverordnung der Europäischen Union oder die Anpassungen des Wiener Übereinkommens über den Straßenverkehr. In deren Grundfassung von 1968 gilt das Paradigma, dass jedes Fahrzeug einen Fahrzeugführer benötigt, welcher die ständige Kontrolle über das zu bewegende Fahrzeug besitzt. Dies bleibt weiterhin die Grundhaltung, jedoch wurde der Einsatz von Fahrassistenzsystemen und automatisierten Fahrfunktionen 2016 durch die Bundesregierung zusätzlich erlaubt. Beispielhaft hierfür wäre eine Notbremsfunktion oder ein selbstständig lenkender Einpark-Assistent, welcher schon vor der Gesetzesänderung Serienreife erhielt. Die Bedingung der Neuregelung besagt außerdem, dass der Fahrzeugführer diese übersteuern bzw. abschalten kann, womit der Fahrer weiterhin die Verantwortung trägt. Die zunehmenden technischen Entwicklungen werden aber auch diesen Rechtsrahmen bald zur Überarbeitung zwingen. Durch den Einsatz von künstlicher Intelligenz (KI) testet beispielsweise Google bereits führerlose Fahrzeuge, welche aufgrund des Wiener Abkommens – und der damit zwingenden Eingriffsmöglichkeit – in Deutschland derzeitig keine Rechtssicherheit besitzen. Da eine Serienreife selbstfahrender Autos bereits in den nächsten Jahren angestrebt wird, hat die aktuelle Bundesregierung eine Überprüfung der erst 2016 verabschiedeten Gesetze im Koalitionsvertrag verankert. Da sich die KI jedoch nicht nur auf Fahrzeuge, sondern die gesamte Robotik bezieht, sind weitreichendere Validierungen der aktuellen Gesetzeslage von Nöten. Insbesondere die Haftung sowie der Vertragsabschluss durch die Abgabe von Willenserklärungen auf Basis eigenständiger Entscheidungen von Maschinen könnten eine Regelungslücke aufweisen. Ob die Entwicklungen der KI de lege lata rechtskonform sind oder wie dies durch Rechtsanalogien und -dogmatiken hergestellt werden könnte, ist ein Gegenstand der Arbeit. Der Fokus liegt jedoch auf der Fragestellung, wie die Einführung eines neuen Rechtssubjekts – die elektronische Person – Abhilfe schaffen könnte.

Hierbei sollen insbesondere die zivilrechtlichen Herausforderungen beleuchtet werden, denen sich Gesetzgebung und Rechtsprechung gegenübersehen. Denn gerade im Bereich des Zivilrechts werden grundlegende Fragen aufgeworfen, die den Umgang mit autonom agierenden Systemen betreffen, angefangen von der Abgabe von Willenserklärungen bis hin zur Frage der Haftung im Falle von Schäden. Die vorliegende Arbeit gliedert sich in mehrere Abschnitte. Zunächst erfolgt eine Klärung grundlegender Begriffe und Konzepte im Zusammenhang mit KI. Darauf aufbauend werden die zivilrechtlichen Herausforderungen, die sich aus dem Einsatz von KI ergeben, eingehend analysiert. Besonderes Augenmerk liegt hierbei auf Fragen der Rechtsfähigkeit und Haftung von autonomen Agenten sowie auf der Suche nach Lösungsansätzen für bestehende Rechtslücken. Ein besonderes Augenmerk wird auch auf die Diskussion um den Rechtsstatus einer elektronischen Person (ePerson) gelegt, wie sie von einigen Experten und sogar vom Europäischen Parlament angeregt wurde. Die Überlegung, autonome Agenten als eigenständige Rechtssubjekte anzuerkennen, wirft grundlegende Fragen auf und könnte potenziell wegweisende Konsequenzen für die Zukunft des Rechtsystems haben. Insgesamt soll diese Arbeit dazu beitragen, ein besseres Verständnis für die rechtlichen Implikationen des Einsatzes Künstlicher Intelligenz zu schaffen und mögliche Lösungswege für aktuelle Herausforderungen aufzuzeigen. In 2009, the UNIDROIT Convention on Substantive Rules for Intermediated Securities (the 'Geneva Securities Convention') was adopted, aimed at harmonisation on the international level. The EU Commission is also running a legislative project, to achieve harmonisation at the regional level.
