Book excerpt: This book analyzes in a comparative way how, and to what extent, the constitutional documents governing territories administered by international organizations (the League of Nations, the UN with the OSCE, and the EU) have provided institutional prerequisites for democratic governance. Territories covered are the Free City of Danzig, the Saar Territory, the Territory of Leticia, the City of Jerusalem, the Free Territory of Trieste, the Congo, West Irian, South West Africa/ Namibia, Cambodia, Somalia, the City of Mostar, Eastern Slavonia, Bosnia and Herzegovina, the District of Brcko, East Timor, and Kosovo. The book begins by discussing problematic issues in international territorial administration, such as evident in the problem of the delineation of the international personality of the territories, the applicability of the concept of democracy, and the enforceability of human rights. It continues by describing the legal framework for democratic governance by delineating the scope of the authority of governance conferred upon international organizations (and/or former states) and local institutions. It applies a framework for democratic governance to the constitutional documents by analyzing to what extent they reflect basic principles of democracy, such as the separation of powers and the independence of the judiciary and the principle of popular sovereignty. The documents are also compared as to provision of mechanisms of accountability and judicial review, political rights, and special participation rights for minorities in institutionalized decision-making processes. Finally, the book proposes ways by which governance in territories administered by international organizations can be democratized, such as by an increased transfer of powers and increased possibilities for popular participation in the government of the territory as well as by modifications to the institutional structures governing the territories.

Book excerpt: The governance of post-conflict territories embodies a central contradiction: how does one help a population prepare for democratic governance and the rule of law by imposing a form of benevolent autocracy? Transitional administrations represent the most complex operations attempted by the United Nations. The operations in East Timor and Kosovo are commonly seen as unique in the history of the UN - perhaps never to be repeated. But they may also be seen as the latest in a series of operations that have involved the United Nations in 'state-building' activities, where it has attempted to develop the institutions of government by assuming some or all of those sovereign powers on a temporary basis. The circumstances that have demanded such interventions certainly will be repeated. Seen in the context of earlier UN operations, such as those in Namibia, Cambodia, and Eastern Slavonia, the view that these exceptional circumstances may not recur is somewhat disingenuous. Moreover, the need for such policy research has been brought into sharp focus by the weighty but ambiguous role assigned to the UN in Afghanistan and the possibility of a comparable role in Iraq. This book fills that gap. Aimed at policy-makers, diplomats, and a wide academic audience (including international relations, political science, international law, and war studies), the book provides a concise history of UN state-building operations and a treatment of the five key issues confronting such an operation on the ground: peace and security, the role of the UN as government, judicial reconstruction, economic reconstruction, and exit strategies.

Four typical elements are identified on the basis of the historical example of the Memel Territory and the so-called Memel case of the PCIJ; distribution of powers, participation through elections and referendums, executive power of territorial autonomy, and international relations. These elements are used for a comparative analysis of the constitutional law that regulates the position of six currently existing special jurisdictions, the Åland Islands in Finalnd, Scotland in the United Kingdom, Puerto Rico in the United States of America, Hong Kong in China, Aceh in Indonesia and Zanzibar in Tanzania. The current sub-state entities examined can be arranged in relation to Memel in a manner that indicates that Hong Kong and the Åland conform to the typical territorial autonomy, while Puerto Rico and Aceh should probably not be understood as territorial autonomies proper. At the same time, the territorial autonomies can be distinguished from federally organized sub-state entities.
